AN ACT concerning regulation. | ||||
Be it enacted by the People of the State of Illinois, | ||||
represented in the General Assembly: | ||||
Section 5. The Nursing Home Care Act is amended by adding | ||||
Section 3-610.5 as follows: | ||||
(210 ILCS 45/3-610.5 new) | ||||
Sec. 3-610.5. Incident and accident reporting. | ||||
(a) Each facility shall notify the Department of any | ||||
incident or accident that results in serious physical harm or | ||||
injury to a resident or any situation in which a resident | ||||
requires immediate medical attention, including admission to a | ||||
hospital, as a direct result of an incident or accident. | ||||
Nothing in this Section precludes reporting of suspected or | ||||
alleged abuse or neglect that must be reported according to | ||||
the Abused and Neglected Long Term Care Facility Residents | ||||
Reporting Act. | ||||
(b) Each facility shall, by phone, by email, by fax, or | ||||
through the Office of Health Care Regulation LLCS Portal, | ||||
notify the appropriate regional office of the Department | ||||
within 24 hours after each reportable incident or accident. | ||||
The facility shall send a narrative summary of each reportable | ||||
incident or accident to the Department within 5 business days | ||||
after the incident or accident. | ||||
