AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Nursing Home Care Act is amended by adding Section 3-610.5 as follows:

Sec. 3-610.5. Incident and accident reporting.

(a) Each facility shall notify the Department of any incident or accident that results in serious physical harm or injury to a resident or any situation in which a resident requires immediate medical attention, including admission to a hospital, as a direct result of an incident or accident. Nothing in this Section precludes reporting of suspected or alleged abuse or neglect that must be reported according to the Abused and Neglected Long Term Care Facility Residents Reporting Act.

(b) Each facility shall, by phone, by email, by fax, or through the Office of Health Care Regulation LLCS Portal, notify the appropriate regional office of the Department within 24 hours after each reportable incident or accident. The facility shall send a narrative summary of each reportable incident or accident to the Department within 5 business days after the incident or accident.
