Synopsis As Introduced
Amends various Acts relating to the governance of public universities in Illinois to make changes concerning in-state tuition to remove a condition concerning attending high school or a community college while residing in this State and not having established residency outside of this State before enrolling in the public university. Amends the Public Community College Act to change specified conditions under which the board of trustees of a community college district is required to deem an individual an Illinois resident. Effective immediately.

Senate Committee Amendment No. 1
Adds reference to:
Provides that, beginning July 1, 2026, for tuition purposes, the board of trustees of a community college district shall deem an individual, other than an individual who has a nonimmigrant alien status that precludes an intent to permanently reside in the United States, an Illinois resident (rather than an Illinois resident, until the individual establishes a residence outside of the State) if certain conditions are met. Amends the Retention of Illinois Students and Equity Act. Provides that "Illinois resident" includes any person who is (i) deemed an Illinois resident for tuition purposes under State law or (ii) charged tuition at the same rate as an Illinois resident under State law.

Senate Committee Amendment No. 2
Provides that the changes made to the provisions of the University of Illinois Act, the Southern Illinois University Management Act, the Chicago State University Law, the Eastern Illinois University Law, the Governors State University Law, the Illinois State University Law, the Northeastern Illinois University Law, the Northern Illinois University Law, and the Western Illinois University Law by the amendatory Act apply beginning with the 2027-2028 academic year. With respect to the Public Community College Act provisions, changes the year references from "2026" to "2027".
