| 4 | "Section 5. The Department of Commerce and Economic | ||||||
| 5 | Opportunity Law of the Civil Administrative Code of Illinois | ||||||
| 6 | is amended by adding Sections 605-1118, 605-1119, 605-1120, | ||||||
| 7 | 605-1121, and 605-1122 as follows: | ||||||
| 8 | (20 ILCS 605/605-1118 new) | ||||||
| 9 | Sec. 605-1118. State Navigator Program Law. This Section | ||||||
| 10 | through Section 605-1122 may be referred to as the State | ||||||
| 11 | Navigator Program Law. | ||||||
| 12 | (20 ILCS 605/605-1119 new) | ||||||
| 13 | Sec. 605-1119. Intent. The General Assembly finds that | ||||||
| 14 | improving the energy efficiency of, and reducing the | ||||||
| 15 | greenhouse gases from, residential buildings are critical to | ||||||
| |||||||
| |||||||
| 1 | meeting the State's adopted climate goals in Public Act | ||||||
| 2 | 102-662. | ||||||
| 3 | The General Assembly recognizes that making information | ||||||
| 4 | about energy efficiency and weatherization programs, | ||||||
| 5 | electrification services, skilled contractors, and federal and | ||||||
| 6 | State electrification incentives available to State residents | ||||||
| 7 | will assist the State in meeting its adopted climate goals in | ||||||
| 8 | Public Act 102-662. Further, the General Assembly recognizes | ||||||
| 9 | that establishing a comprehensive statewide navigator program | ||||||
| 10 | is essential to ensuring equitable access to electrification | ||||||
| 11 | and energy efficient services. This program requires the | ||||||
| 12 | Administrator to help educate residents on how to combine | ||||||
| 13 | local, State, federal, and utility services related to | ||||||
| 14 | electrification, energy efficiency, and the reduction of | ||||||
| 15 | energy burdens to maximize electrification and energy | ||||||
| 16 | efficiency in this State. | ||||||
| 17 | (20 ILCS 605/605-1120 new) | ||||||
| 18 | Sec. 605-1120. Definitions. As used in the State Navigator | ||||||
| 19 | Program Law: | ||||||
| 20 | "Administrator" means an entity, including, but not | ||||||
| 21 | limited to, a nonprofit corporation or community-based | ||||||
| 22 | organization. "Administrator" does not include an energy | ||||||
| 23 | utility. | ||||||
| 24 | "Customers" means residents, tenants, homeowners, and | ||||||
| 25 | building owners. | ||||||
| |||||||
| |||||||
| 1 | "Department" means the Department of Commerce and Economic | ||||||
| 2 | Opportunity. | ||||||
| 3 | "Electrification services" includes energy audits, | ||||||
| 4 | assistance converting to on-site renewable energy, electric | ||||||
| 5 | load service center upgrades, new electric wiring, installing | ||||||
| 6 | electric heat pumps and heat pump water heaters, cooking | ||||||
| 7 | equipment, clothes dryers, and other electric appliance | ||||||
| 8 | replacement, financing, energy efficiency, weatherization, | ||||||
| 9 | health and safety improvements, and any energy upgrade | ||||||
| 10 | services and work. | ||||||
| 11 | "Equity investment eligible communities" has the meaning | ||||||
| 12 | given to that term in Section 5-5 of the Energy Transition Act. | ||||||
| 13 | "Income-qualified households" means those whose annual | ||||||
| 14 | incomes are at or below 80% of area median income. | ||||||
| 15 | "Navigator Working Group" means representatives appointed | ||||||
| 16 | by the Department who represent members from either the | ||||||
| 17 | electrician trades, construction industry, community | ||||||
| 18 | organizations that work in energy burdened communities, | ||||||
| 19 | community organizations who have experience with | ||||||
| 20 | weatherization programs, members from equity investment | ||||||
| 21 | eligible communities or the Illinois Commerce Commission or | ||||||
| 22 | staff, electric utilities, and other stakeholders deemed | ||||||
| 23 | necessary by the Administrator. | ||||||
| 24 | (20 ILCS 605/605-1121 new) | ||||||
| 25 | Sec. 605-1121. Creation of State navigator program. | ||||||
| |||||||
| |||||||
| 1 | (a) The Department may establish and oversee a statewide | ||||||
| 2 | building energy upgrade navigator program. The purpose of the | ||||||
| 3 | navigator program is to provide a statewide resource to assist | ||||||
| 4 | building owners and building renters with accessing | ||||||
| 5 | information about electrification services, energy efficiency | ||||||
| 6 | services, programs, funding, and any other assistance that | ||||||
| 7 | will result in aiding the State in meeting its adopted climate | ||||||
| 8 | goals in Public Act 102-662. This includes, but is not limited | ||||||
| 9 | to, utility programs, the weatherization assistance program, | ||||||
| 10 | solar for all, federal funding and financing, and State and | ||||||
| 11 | local funding and financing. | ||||||
| 12 | (b) The Department must coordinate and collaborate with | ||||||
| 13 | the navigator working group on the design, administration, and | ||||||
| 14 | implementation of the navigator program. | ||||||
| 15 | (c) The Department must ensure that all State residents | ||||||
| 16 | have equitable access to the navigator program. | ||||||
| 17 | (d) The Department may consult with other programs, | ||||||
| 18 | entities, and stakeholders as the Department determines to be | ||||||
| 19 | appropriate on the design, administration, and implementation | ||||||
| 20 | of the navigator program. The Department must solicit public | ||||||
| 21 | feedback on design and implementation decisions from | ||||||
| 22 | stakeholders. | ||||||
| 23 | (e) Third-Party Administrator. | ||||||
| 24 | (1) The Department may contract out this program to | ||||||
| 25 | the Administrator. Subject to the following requirements: | ||||||
| 26 | (A) The Administrator must be selected through a | ||||||
| |||||||
| |||||||
| 1 | competitive process. | ||||||
| 2 | (B) The Administrator must have experience with | ||||||
| 3 | running statewide programs related to energy | ||||||
| 4 | efficiency, electrification services, or | ||||||
| 5 | weatherization programs. | ||||||
| 6 | (C) The Administrator must have experience working | ||||||
| 7 | with multifamily building owners and renters. | ||||||
| 8 | (D) The Administrator must have experience | ||||||
| 9 | assisting people with low incomes or energy burdened | ||||||
| 10 | households. | ||||||
| 11 | (E) The Administrator must have experience running | ||||||
| 12 | programs in both urban and rural parts of the State, | ||||||
| 13 | including covering a range of geographic and community | ||||||
| 14 | diversity. | ||||||
| 15 | (2) If the Department decides to hire an | ||||||
| 16 | Administrator, the Administrator must enter into a | ||||||
| 17 | contract with the Department within a year of the | ||||||
| 18 | effective date of this amendatory Act of the 104th General | ||||||
| 19 | Assembly. | ||||||
| 20 | (3) If the Department decides to hire an | ||||||
| 21 | Administrator, the Administrator's contract expires after | ||||||
| 22 | 4 years. After 4 years, the Department can renew the | ||||||
| 23 | contract or select a different Administrator. If the | ||||||
| 24 | Administrator is not meeting the requirements of the | ||||||
| 25 | program and its participants, the contract may be | ||||||
| 26 | terminated early, and a new Administrator may be hired. | ||||||
| |||||||
| |||||||
| 1 | (4) The Administrator shall have the same | ||||||
| 2 | responsibilities as the Department in creating, | ||||||
| 3 | overseeing, and implementing the programs in the navigator | ||||||
| 4 | program. | ||||||
| 5 | (f) The Department or Administrator of the navigator | ||||||
| 6 | program must: | ||||||
| 7 | (1) provide outreach to: | ||||||
| 8 | (A) owner occupied and rental residences; and | ||||||
| 9 | (B) single-family and multifamily dwellings; | ||||||
| 10 | (2) provide coverage for all geographic regions in the | ||||||
| 11 | State; | ||||||
| 12 | (3) create strategies to ensure that the navigator | ||||||
| 13 | program prioritizes outreach in equity investment eligible | ||||||
| 14 | communities; | ||||||
| 15 | (4) create a strategy for how the navigator program | ||||||
| 16 | will equitably assist residents in accessing rebates and | ||||||
| 17 | incentives in the federal Inflation Reduction Act; | ||||||
| 18 | (5) create a strategy for how the navigator program | ||||||
| 19 | will assist customers in accessing State funding | ||||||
| 20 | opportunities available to access electrification | ||||||
| 21 | services; | ||||||
| 22 | (6) create a strategy to stack funding from all | ||||||
| 23 | available incentives and tax rebates that may leverage | ||||||
| 24 | existing State software where possible with the goal of | ||||||
| 25 | creating a single interface for clients to access | ||||||
| 26 | information about weatherization, energy efficiency, and | ||||||
| |||||||
| |||||||
| 1 | electrification services; | ||||||
| 2 | (7) support the integrated implementation of all | ||||||
| 3 | relevant clean building programs funded in the State | ||||||
| 4 | budget, including, but not limited to: | ||||||
| 5 | (A) the Low Income Home Energy Assistance Program; | ||||||
| 6 | and | ||||||
| 7 | (B) the Illinois Home Weatherization Assistance | ||||||
| 8 | Program; and | ||||||
| 9 | (8) maintain a recommended contractor list. | ||||||
| 10 | (20 ILCS 605/605-1122 new) | ||||||
| 11 | Sec. 605-1122. Education materials and outreach. The | ||||||
| 12 | Department or Administrator shall: | ||||||
| 13 | (1) create educational materials, which must include: | ||||||
| 14 | (a) information about all relevant funds and | ||||||
| 15 | financial assistance available from federal, State, | ||||||
| 16 | local, and energy utility programs, including, but not | ||||||
| 17 | limited to, incentives, rebates, tax credits, grants, | ||||||
| 18 | and loan programs; and | ||||||
| 19 | (b) information for households on the economic, | ||||||
| 20 | health, climate, and safety benefits of eligible | ||||||
| 21 | retrofits; | ||||||
| 22 | (2) support and connect community-based organizations | ||||||
| 23 | in their region to training programs in areas of | ||||||
| 24 | electrification, energy efficiency, building envelope, and | ||||||
| 25 | installation technical assistance, and other relevant | ||||||
| |||||||
| |||||||
| 1 | areas; and | ||||||
| 2 | (3) ensure the education and outreach work is | ||||||
| 3 | coordinated with other State energy efficiency, | ||||||
| 4 | weatherization, electrification, and related programs and | ||||||
| 5 | providers. | ||||||
| 6 | Section 99. Effective date. This Act takes effect upon | ||||||
| 7 | becoming law.". | ||||||
