| 2 | AMENDMENT NO. ______. Amend House Bill 2504 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
| 5 | changing Sections 3-400 and 3-413 and by adding Section | ||||||
| 6 | 1-137.10 as follows: | ||||||
| 7 | (625 ILCS 5/1-137.10 new) | ||||||
| 8 | Sec. 1-137.10. License plate flipper. A device designed or | ||||||
| 9 | adapted to be installed on a vehicle that by manual, | ||||||
| 10 | electronic, mechanical, or other means alternates between 2 or | ||||||
| 11 | more license plates or purported license plates or hides or | ||||||
| 12 | conceals a license plate, making the license plate number not | ||||||
| 13 | visible. | ||||||

| 15 | Sec. 3-413. Display of registration plates or digital | ||||||

| 1 | registration plates, registration stickers or digital | ||||||
| 2 | registration stickers, and drive-away permits; registration | ||||||
| 3 | plate or digital registration plate covers. | ||||||
| 4 | (a) Registration plates or digital registration plates | ||||||
| 5 | issued for a motor vehicle other than a motorcycle, autocycle, | ||||||
| 6 | trailer, semitrailer, truck-tractor, apportioned bus, or | ||||||
| 7 | apportioned truck shall be attached thereto, one in the | ||||||
| 8 | frontmost and one in the rearmost. The registration plate or | ||||||
| 9 | digital registration plate issued for a motorcycle, autocycle, | ||||||
| 10 | trailer or semitrailer required to be registered hereunder and | ||||||
| 11 | any apportionment plate issued to a bus under the provisions | ||||||
| 12 | of this Code shall be attached to the rearmost thereof. The | ||||||
| 13 | registration plate or digital registration plate issued for a | ||||||
| 14 | truck-tractor or an apportioned truck required to be | ||||||
| 15 | registered hereunder shall be attached to the frontmost | ||||||
| 16 | thereof. | ||||||
| 17 | (b) Except for vehicles with rear loaded motorized | ||||||
| 18 | forklifts, every registration plate or digital registration | ||||||
| 19 | plate shall at all times be securely fastened in a horizontal | ||||||
| 20 | position to the vehicle for which it is issued so as to prevent | ||||||
| 21 | the plate from swinging and at a height of not less than 5 | ||||||
| 22 | inches from the ground, measuring from the bottom of such | ||||||
| 23 | plate, in a place and position to be clearly visible and shall | ||||||
| 24 | be maintained in a condition to be clearly legible, free from | ||||||
| 25 | any materials that would obstruct the visibility of the plate. | ||||||
| 26 | A registration plate or digital registration plate on a | ||||||
| |||||||
| |||||||
| 1 | motorcycle may be mounted vertically as long as it is | ||||||
| 2 | otherwise clearly visible. Registration stickers or digital | ||||||
| 3 | registration stickers issued as evidence of renewed annual | ||||||
| 4 | registration shall be attached to registration plates or | ||||||
| 5 | displayed on digital registration plates as required by the | ||||||
| 6 | Secretary of State, and be clearly visible at all times and | ||||||
| 7 | displayed as prescribed in subsection (k). For those vehicles | ||||||
| 8 | with rear loaded motorized forklifts, if the rear plate is | ||||||
| 9 | securely fastened in a horizontal position as prescribed, the | ||||||
| 10 | plate and registration sticker shall not be required to be | ||||||
| 11 | clearly visible at all times as a result of the rear mounted | ||||||
| 12 | motorized forklift obstructing the view. | ||||||
| 13 | (c) Every drive-away permit issued pursuant to this Code | ||||||
| 14 | shall be firmly attached to the motor vehicle in the manner | ||||||
| 15 | prescribed by the Secretary of State. If a drive-away permit | ||||||
| 16 | is affixed to a motor vehicle in any other manner the permit | ||||||
| 17 | shall be void and of no effect. | ||||||
| 18 | (d) The Illinois prorate decal issued to a foreign | ||||||
| 19 | registered vehicle part of a fleet prorated or apportioned | ||||||
| 20 | with Illinois, shall be displayed on a registration plate or | ||||||
| 21 | digital registration plate and displayed on the frontmost of | ||||||
| 22 | such vehicle in the same manner as an Illinois registration | ||||||
| 23 | plate or digital registration plate. | ||||||
| 24 | (e) The registration plate or digital registration plate | ||||||
| 25 | issued for a camper body mounted on a truck displaying | ||||||
| 26 | registration plates or digital registration plates shall be | ||||||
| |||||||
| |||||||
| 1 | attached to the rearmost of the camper body. | ||||||
| 2 | (f) No person shall operate a vehicle, nor permit the | ||||||
| 3 | operation of a vehicle, upon which is displayed an Illinois | ||||||
| 4 | registration plate or plates or digital registration plate or | ||||||
| 5 | plates or registration stickers or digital registration | ||||||
| 6 | stickers, except as provided for in subsection (b) of Section | ||||||
| 7 | 3-701 of this Code, after the termination of the registration | ||||||
| 8 | period for which issued or after the expiration date set | ||||||
| 9 | pursuant to Sections 3-414 and 3-414.1 of this Code. | ||||||
| 10 | (g) A person may not operate any motor vehicle that is | ||||||
| 11 | equipped with registration plate or digital registration plate | ||||||
| 12 | covers. A violation of this subsection (g) or a similar | ||||||
| 13 | provision of a local ordinance is an offense against laws and | ||||||
| 14 | ordinances regulating the movement of traffic. | ||||||
| 15 | (h) A person may not sell or offer for sale a registration | ||||||
| 16 | plate or digital registration plate cover. A violation of this | ||||||
| 17 | subsection (h) is a business offense. | ||||||
| 18 | (i) A person may not advertise for the purpose of | ||||||
| 19 | promoting the sale of registration plate or digital | ||||||
| 20 | registration plate covers. A violation of this subsection (i) | ||||||
| 21 | is a business offense. | ||||||
| 22 | (j) A person may not modify the original manufacturer's | ||||||
| 23 | mounting location of any the rear registration plate or | ||||||
| 24 | digital registration plate on any vehicle, nor shall any | ||||||
| 25 | person or operator so as to conceal a vehicle's the | ||||||
| 26 | registration or to knowingly cause it to be obstructed in an | ||||||
| |||||||
| |||||||
| 1 | effort to hinder a peace officer from obtaining the | ||||||
| 2 | registration for the enforcement of a violation of this Code, | ||||||
| 3 | Section 27.1 of the Toll Highway Act concerning toll evasion, | ||||||
| 4 | or any municipal ordinance or to circumvent plate detection | ||||||
| 5 | systems. Modifications prohibited by this subsection (j) | ||||||
| 6 | include but are not limited to the use of a license plate | ||||||
| 7 | flipper an electronic device. A person may not purchase or | ||||||
| 8 | possess, nor manufacture, sell, offer for sale, or otherwise | ||||||
| 9 | distribute a license plate flipper. A violation of this | ||||||
| 10 | subsection (j) is a Class A misdemeanor. | ||||||
| 11 | (k) Registration stickers issued as evidence of renewed | ||||||
| 12 | registration by the Secretary shall be displayed on the upper | ||||||
| 13 | right corner of the rear registration plate or in a manner | ||||||
| 14 | otherwise provided by the Secretary. However, registration | ||||||
| 15 | stickers issued to truck-tractors shall be displayed on the | ||||||
| 16 | upper right corner of the front registration plate or in a | ||||||
| 17 | manner otherwise provided by the Secretary. | ||||||
| 18 | (l) No person shall affix to any registration plate, | ||||||
| 19 | temporary registration plate, digital registration plate, | ||||||
| 20 | registration sticker, or other evidence of registration issued | ||||||
| 21 | by the Secretary any medallion, insignia, tape, sticker, or | ||||||
| 22 | other object not issued or approved by the Secretary. No | ||||||
| 23 | person shall alter, manipulate, apply, or otherwise manipulate | ||||||
| 24 | any evidence of registration issued by the Secretary in any | ||||||
| 25 | manner from the original condition as was received when issued | ||||||
| 26 | by the Secretary. It is unlawful to operate any vehicle that | ||||||

| 1 | displays evidence of registration altered in any manner or | ||||||
| 2 | displaying any medallion, insignia, sticker, or other object | ||||||
| 3 | as prescribed in this subsection. | ||||||
