| 1 | AN ACT concerning regulation. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 5. The Pharmacy Practice Act is amended by adding | |||||||||||||||||||
| 5 | Section 45 as follows: | |||||||||||||||||||
| 6 | (225 ILCS 85/45 new) | |||||||||||||||||||
| 7 | Sec. 45. Inventory standards for large pharmacy chains. | |||||||||||||||||||
| 8 | (a) As used in this Section: | |||||||||||||||||||
| 9 | "Large pharmacy chain" means an entity that is engaged in | |||||||||||||||||||
| 10 | the practice of pharmacy, that operates at scale, and that | |||||||||||||||||||
| 11 | meets one or more of the following characteristics: | |||||||||||||||||||
| 12 | (1) the entity operates 10 or more retail pharmacy | |||||||||||||||||||
| 13 | locations statewide or 50 or more retail pharmacy | |||||||||||||||||||
| 14 | locations nationally; | |||||||||||||||||||
| 15 | (2) the entity is owned, operated, or franchised by a | |||||||||||||||||||
| 16 | national or regional corporation; and | |||||||||||||||||||
| 17 | (3) the entity utilizes centralized purchasing, | |||||||||||||||||||
| 18 | distribution, or inventory management systems across | |||||||||||||||||||
| 19 | multiple locations. | |||||||||||||||||||
| 20 | "Retail pharmacy" means a store, shop, or other place | |||||||||||||||||||
| 21 | where drugs, medicines, or poisons are dispensed, sold, or | |||||||||||||||||||
| 22 | offered for sale at retail or displayed for sale at retail. | |||||||||||||||||||
| 23 | (b) A large pharmacy chain operating in this State shall | |||||||||||||||||||
| |||||||
| |||||||
| 1 | ensure that each of the large pharmacy chain's retail pharmacy | ||||||
| 2 | locations maintains, at minimum, an inventory that is | ||||||
| 3 | sufficient to cover the needs of existing patients for up to 14 | ||||||
| 4 | days without needing to restock. Each retail pharmacy location | ||||||
| 5 | shall implement a predictive restocking practice to prevent or | ||||||
| 6 | mitigate future inventory shortages. | ||||||
| 7 | (c) If a patient attempts to fill a prescription that a | ||||||
| 8 | retail pharmacy location does not have in stock, the retail | ||||||
| 9 | pharmacy location shall provide timely mail-order fulfillment, | ||||||
| 10 | up to and including overnight shipping, if necessary to | ||||||
| 11 | provide a medication approved by the United States Food and | ||||||
| 12 | Drug Administration in time to ensure no missed doses. | ||||||
| 13 | Overnight shipping shall only be required when deemed | ||||||
| 14 | medically necessary or otherwise confirmed by the prescribing | ||||||
| 15 | physician. | ||||||
