| 1 | AN ACT concerning public aid. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 5. The Illinois Public Aid Code is amended by | |||||||||||||||||||
| 5 | adding Section 5-54 as follows: | |||||||||||||||||||
| 6 | (305 ILCS 5/5-54 new) | |||||||||||||||||||
| 7 | Sec. 5-54. Electronic visit verification system; live-in | |||||||||||||||||||
| 8 | caregiver exemption, waiver, and renewal. | |||||||||||||||||||
| 9 | (a) Subject to federal approval, any individual who is | |||||||||||||||||||
| 10 | initially approved to provide personal care services as a | |||||||||||||||||||
| 11 | live-in caregiver under the Adults with Developmental | |||||||||||||||||||
| 12 | Disabilities Waiver or the Support Waiver for Children and | |||||||||||||||||||
| 13 | Young Adults but is subsequently ordered by the Department of | |||||||||||||||||||
| 14 | Human Services' Division of Developmental Disabilities to | |||||||||||||||||||
| 15 | complete mandatory electronic visit verification (EVV) | |||||||||||||||||||
| 16 | training on account of the individual submitting an incomplete | |||||||||||||||||||
| 17 | or insufficient application for the live-in caregiver | |||||||||||||||||||
| 18 | exemption from EVV requirements shall be allowed a one-time | |||||||||||||||||||
| 19 | waiver of the mandatory EVV training if: | |||||||||||||||||||
| 20 | (1) the individual's application for the live-in | |||||||||||||||||||
| 21 | caregiver exemption was determined by the Department to be | |||||||||||||||||||
| 22 | incomplete or insufficient due to missing documentation; | |||||||||||||||||||
| 23 | (2) the individual is otherwise eligible for the | |||||||||||||||||||
| |||||||
| |||||||
| 1 | live-in caregiver exemption as authorized under federal | ||||||
| 2 | guidelines and regulations; and | ||||||
| 3 | (3) the individual has not previously been ordered to | ||||||
| 4 | complete mandatory EVV training. | ||||||
| 5 | The Department of Human Services shall develop, by rule, a | ||||||
| 6 | process for waiver applications. Upon approval of an | ||||||
| 7 | individual's application for a waiver of mandatory EVV | ||||||
| 8 | training, the Department shall determine the individual to be | ||||||
| 9 | approved for the live-in caregiver exemption and in compliance | ||||||
| 10 | with all EVV requirements. No individual may benefit from a | ||||||
| 11 | waiver of mandatory EVV training more than once. | ||||||
| 12 | (b) Subject to federal approval, any individual who is | ||||||
| 13 | approved for the live-in caregiver exemption either through | ||||||
| 14 | formal application or a waiver provided under subsection (a) | ||||||
| 15 | shall be required to renew the exemption by written | ||||||
| 16 | application every 5 years. | ||||||
| 17 | Section 99. Effective date. This Act takes effect upon | ||||||
| 18 | becoming law. | ||||||
