SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-54 new
    Amends the Illinois Public Aid Code. Provides that, subject to federal approval, any individual who is initially approved to provide personal care services as a live-in caregiver under the Adults with Developmental Disabilities Waiver or the Support Waiver for Children and Young Adults but is subsequently ordered by the Department of Human Services to complete mandatory electronic visit verification (EVV) training on account of the individual submitting an incomplete or insufficient application for the live-in caregiver exemption from EVV requirements shall be allowed a one-time waiver of the mandatory EVV training if: (i) the individual's application for the live-in caregiver exemption was determined by the Department to be incomplete or insufficient due to missing documentation; (ii) the individual is otherwise eligible for the live-in caregiver exemption; and (iii) the individual has not previously been ordered to complete mandatory EVV training. Provides that, subject to federal approval, any individual who is approved for the live-in caregiver exemption either through formal application or a waiver shall be required to renew the exemption by written application every 5 years. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by 
5adding Section 5-54 as follows:
 
6    (305 ILCS 5/5-54 new)
7    Sec. 5-54. Electronic visit verification system; live-in 
8caregiver exemption, waiver, and renewal. 
9    (a) Subject to federal approval, any individual who is 
10initially approved to provide personal care services as a 
11live-in caregiver under the Adults with Developmental 
12Disabilities Waiver or the Support Waiver for Children and 
13Young Adults but is subsequently ordered by the Department of 
14Human Services' Division of Developmental Disabilities to 
15complete mandatory electronic visit verification (EVV) 
16training on account of the individual submitting an incomplete 
17or insufficient application for the live-in caregiver 
18exemption from EVV requirements shall be allowed a one-time 
19waiver of the mandatory EVV training if: 
20        (1) the individual's application for the live-in 
21    caregiver exemption was determined by the Department to be 
22    incomplete or insufficient due to missing documentation; 
23        (2) the individual is otherwise eligible for the

1    live-in caregiver exemption as authorized under federal 
2    guidelines and regulations; and 
3        (3) the individual has not previously been ordered to 
4    complete mandatory EVV training. 
5    The Department of Human Services shall develop, by rule, a 
6process for waiver applications. Upon approval of an 
7individual's application for a waiver of mandatory EVV 
8training, the Department shall determine the individual to be 
9approved for the live-in caregiver exemption and in compliance 
10with all EVV requirements. No individual may benefit from a 
11waiver of mandatory EVV training more than once.
12    (b) Subject to federal approval, any individual who is 
13approved for the live-in caregiver exemption either through 
14formal application or a waiver provided under subsection (a) 
15shall be required to renew the exemption by written 
16application every 5 years.
 
17    Section 99. Effective date. This Act takes effect upon 
18becoming law.
