| 1 | AN ACT concerning criminal law. | |||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||||
| 4 | Section 5. The Criminal Code of 2012 is amended by | |||||||||||||||||||||
| 5 | changing Sections 9-3.4 and 9-3.5 as follows: | |||||||||||||||||||||
| 6 | (720 ILCS 5/9-3.4) (was 720 ILCS 5/9-3.1) | |||||||||||||||||||||
| 7 | Sec. 9-3.4. Concealment of homicidal death. | |||||||||||||||||||||
| 8 | (a) A person commits the offense of concealment of | |||||||||||||||||||||
| 9 | homicidal death when he or she knowingly conceals the death of | |||||||||||||||||||||
| 10 | any other person with knowledge that such other person has | |||||||||||||||||||||
| 11 | died by homicidal means. | |||||||||||||||||||||
| 12 | (a-5) A person commits the offense of concealment of | |||||||||||||||||||||
| 13 | homicidal death when he or she knowingly permits the | |||||||||||||||||||||
| 14 | concealment or disposal of a body on property under the | |||||||||||||||||||||
| 15 | person's control with knowledge that the other person has died | |||||||||||||||||||||
| 16 | by homicidal means. | |||||||||||||||||||||
| 17 | (b) Nothing in this Section prevents the defendant from | |||||||||||||||||||||
| 18 | also being charged with and tried for the first degree murder, | |||||||||||||||||||||
| 19 | second degree murder, or involuntary manslaughter of the | |||||||||||||||||||||
| 20 | person whose death is concealed. | |||||||||||||||||||||
| 21 | (b-5) For purposes of this Section: | |||||||||||||||||||||
| 22 | "Conceal" means the performing of some act or acts for the | |||||||||||||||||||||
| 23 | purpose of preventing or delaying the discovery of a death by | |||||||||||||||||||||

| 1 | homicidal means. "Conceal" means something more than simply | ||||||
| 2 | withholding knowledge or failing to disclose information. | ||||||
| 3 | "Homicidal means" means any act or acts, lawful or | ||||||
| 4 | unlawful, of a person that cause the death of another person. | ||||||
| 5 | (c) Sentence. Concealment of homicidal death is a Class 2 | ||||||
| 6 | 3 felony. | ||||||

| 9 | Sec. 9-3.5. Concealment of death. | ||||||
| 10 | (a) For purposes of this Section, "conceal" means the | ||||||
| 11 | performing of some act or acts for the purpose of preventing or | ||||||
| 12 | delaying the discovery of a death. "Conceal" means something | ||||||
| 13 | more than simply withholding knowledge or failing to disclose | ||||||
| 14 | information. | ||||||
| 15 | (b) A person commits the offense of concealment of death | ||||||
| 16 | when he or she knowingly conceals the death of any other person | ||||||
| 17 | who died by other than homicidal means. | ||||||
| 18 | (c) A person commits the offense of concealment of death | ||||||
| 19 | when he or she knowingly moves the body of a dead person from | ||||||
| 20 | its place of death, with the intent of concealing information | ||||||
| 21 | regarding the place or manner of death of that person, or the | ||||||
| 22 | identity of any person with information regarding the death of | ||||||
| 23 | that person. This subsection shall not apply to any movement | ||||||
| 24 | of the body of a dead person by medical personnel, fire | ||||||
| 25 | fighters, law enforcement officers, coroners, medical | ||||||

| 1 | examiners, or licensed funeral directors, or by any person | ||||||
| 2 | acting at the direction of medical personnel, fire fighters, | ||||||
| 3 | law enforcement officers, coroners, medical examiners, or | ||||||
| 4 | licensed funeral directors. | ||||||
| 5 | (c-5) A person commits the offense of concealment of death | ||||||
| 6 | when he or she knowingly permits the concealment or disposal | ||||||
| 7 | of a body on property under the person's control with the | ||||||
| 8 | intent of concealing information regarding the place or manner | ||||||
| 9 | of death of that person, or the identity of any person with | ||||||
| 10 | information regarding the death of that person. | ||||||
| 11 | (d) Sentence. Concealment of death is a Class 3 4 felony. | ||||||

| 13 | Section 99. Effective date. This Act takes effect upon | ||||||
| 14 | becoming law. | ||||||
