| 1 | AN ACT concerning children. | ||||||
| 2 | Be it enacted by the People of the State of Illinois, | ||||||
| 3 | represented in the General Assembly: | ||||||
| 4 | Section 5. The Birth Control Services to Minors Act is | ||||||
| 5 | amended by changing Section 1 as follows: | ||||||
| 6 | (325 ILCS 10/1) (from Ch. 111 1/2, par. 4651) | ||||||
| 7 | Sec. 1. | ||||||
| 8 | (a) As used in this Section: | ||||||
| 9 | "Contraceptive services" has the same meaning ascribed to | ||||||
| 10 | that term in paragraph (2) of subsection (a) of Section 356z.4 | ||||||
| 11 | of the Illinois Insurance Code, but does not include | ||||||
| 12 | sterilization. | ||||||
| 13 | "Contraceptive supplies" means all contraceptive drugs, | ||||||
| 14 | devices, and products approved by the federal Food and Drug | ||||||
| 15 | Administration to prevent pregnancy, including long-acting | ||||||
| 16 | reversible contraceptives, nonprescription oral hormonal | ||||||
| 17 | contraceptives, and nonprescription emergency contraceptives. | ||||||
| 18 | (b) Any minor may give effective consent for contraceptive | ||||||
| 19 | services or supplies and the consent of no other person is | ||||||
| 20 | required. A request for prescription contraceptive services or | ||||||
| 21 | supplies shall be made to a physician licensed to practice | ||||||
| 22 | medicine in all of its branches, an advanced practice | ||||||
| 23 | registered nurse or a physician assistant licensed to practice | ||||||

| 1 | in the State, or a pharmacist pursuant to the Pharmacy | ||||||
| 2 | Practice Act. For the purposes of accessing contraceptive | ||||||
| 3 | services or supplies under this Act, a minor is deemed to have | ||||||
| 4 | the same legal capacity to act and has the same powers and | ||||||
| 5 | obligations as a person of legal age. | ||||||
| 6 | Birth control services and information may be rendered by | ||||||
| 7 | doctors licensed in Illinois to practice medicine in all of | ||||||
| 8 | its branches to any minor: | ||||||
| 9 | 1. who is married; or | ||||||
| 10 | 2. who is a parent; or | ||||||
| 11 | 3. who is pregnant; or | ||||||
| 12 | 4. who has the consent of his parent or legal guardian; or | ||||||
| 13 | 5. as to whom the failure to provide such services would | ||||||
| 14 | create a serious health hazard; or | ||||||
| 15 | 6. who is referred for such services by a physician, | ||||||
| 16 | clergyman or a planned parenthood agency. | ||||||
