| 1 | AN ACT concerning wildlife. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 5. The Wildlife Code is amended by adding Section | |||||||||||||||||||
| 5 | 2.1a as follows: | |||||||||||||||||||
| 6 | (520 ILCS 5/2.1a new) | |||||||||||||||||||
| 7 | Sec. 2.1a. Compensation for damages caused by deer. | |||||||||||||||||||
| 8 | (a) If wild deer cause more than $500 in property damage on | |||||||||||||||||||
| 9 | land in the State that is owned or leased by an Illinois | |||||||||||||||||||
| 10 | resident, then the Department shall compensate the Illinois | |||||||||||||||||||
| 11 | resident for the actual property damages caused by the deer | |||||||||||||||||||
| 12 | and incurred by the Illinois resident upon submittal by the | |||||||||||||||||||
| 13 | Illinois resident of a claim in the form and manner prescribed | |||||||||||||||||||
| 14 | by the Department by rule. A claim submitted under this | |||||||||||||||||||
| 15 | subsection must be submitted within one year after the date | |||||||||||||||||||
| 16 | that a claimant suffers damages that are compensable under | |||||||||||||||||||
| 17 | this subsection and knows or has reason to know of the damages. | |||||||||||||||||||
| 18 | The Department shall adopt rules to implement this subsection. | |||||||||||||||||||
| 19 | (b) If an Illinois resident who is entitled to | |||||||||||||||||||
| 20 | compensation under subsection (a) is not compensated by the | |||||||||||||||||||
| 21 | Department within 180 days after submitting a claim in the | |||||||||||||||||||
| 22 | form and manner prescribed by the Department, the Illinois | |||||||||||||||||||
| 23 | resident may bring an action against the State of Illinois in | |||||||||||||||||||
| |||||||
| |||||||
| 1 | the Court of Claims for the actual property damages incurred | ||||||
| 2 | by the Illinois resident. | ||||||
