| 1 | AN ACT concerning safety. | ||||||
| 2 | Be it enacted by the People of the State of Illinois, | ||||||
| 3 | represented in the General Assembly: | ||||||
| 4 | Section 5. The Electric Vehicle Rebate Act is amended by | ||||||
| 5 | changing Sections 10, 15, 27, and 40 as follows: | ||||||
| 6 | (415 ILCS 120/10) | ||||||
| 7 | Sec. 10. Definitions. As used in this Act: | ||||||
| 8 | "Agency" means the Environmental Protection Agency. | ||||||
| 9 | "Covered Area" means the counties of Cook, DuPage, Kane, | ||||||
| 10 | Lake, McHenry, and Will, the townships of Aux Sable and Goose | ||||||
| 11 | Lake in Grundy County, and the township of Oswego in Kendall | ||||||
| 12 | County. | ||||||
| 13 | "Electric vehicle" means a vehicle that is exclusively | ||||||
| 14 | powered by and refueled by electricity, must be plugged in to | ||||||
| 15 | charge, and is legally permitted licensed to drive on all | ||||||
| 16 | public roadways, including interstate highways. "Electric | ||||||
| 17 | Vehicle" does not include electric mopeds, electric | ||||||
| 18 | off-highway vehicles primarily intended to be driven | ||||||
| 19 | off-highway, including golf carts and electric vehicles with a | ||||||
| 20 | maximum speed below 45 miles per hour, or hybrid electric | ||||||
| 21 | vehicles and extended-range electric vehicles that are also | ||||||
| 22 | equipped with conventional fueled propulsion or auxiliary | ||||||
| 23 | engines. | ||||||

| 1 | "Eligible applicant" means persons and families whose | ||||||
| 2 | income does not exceed 500% of the federal poverty line for the | ||||||
| 3 | current State fiscal year and who may not be claimed as a | ||||||
| 4 | dependent. | ||||||
| 5 | "Eligible vehicle" means an electric vehicle, as defined | ||||||
| 6 | by this Act, with a selling price not exceeding $80,000 as | ||||||
| 7 | shown on the bill of sale, that has not previously received a | ||||||
| 8 | rebate under this Act. For the purposes of this Act, State and | ||||||
| 9 | local taxes, license and registration fees, documentary | ||||||
| 10 | service fees, and aftermarket products, including, but not | ||||||
| 11 | limited to, extended warranties, service contracts, and other | ||||||
| 12 | voluntary vehicle protection products, are excluded from the | ||||||
| 13 | calculation of the selling price if separately itemized on the | ||||||
| 14 | bill of sale. | ||||||
| 15 | "Environmental justice community" has the same meaning, | ||||||
| 16 | based on existing methodologies and findings, used and as may | ||||||
| 17 | be updated by the Illinois Power Agency and its Program | ||||||
| 18 | Administrator of the Illinois Solar for All Program. | ||||||
| 19 | "Low-income applicants Low income" means persons and | ||||||
| 20 | families whose income does not exceed 80% of the regional or | ||||||
| 21 | county State median income for the current State fiscal year, | ||||||
| 22 | as established by the United States Department of Housing and | ||||||
| 23 | Urban Development's Illinois Income Limits by metropolitan | ||||||
| 24 | area and county Health and Human Services. | ||||||

| 2 | Sec. 15. Rulemaking. The Agency shall adopt promulgate | ||||||
| 3 | rules as necessary and dedicate sufficient resources to | ||||||
| 4 | implement Section 27 of this Act. Such rules shall be | ||||||
| 5 | consistent with applicable provisions of the Clean Air Act and | ||||||
| 6 | any regulations promulgated pursuant thereto. The Secretary of | ||||||
| 7 | State may adopt promulgate rules to implement Section 35 of | ||||||
| 8 | this Act. | ||||||

| 12 | Sec. 27. Electric vehicle rebate. | ||||||
| 13 | (a) Beginning July 1, 2022, and continuing as long as | ||||||
| 14 | funds are available, each eligible applicant person shall be | ||||||
| 15 | eligible to apply for a rebate, in the amounts set forth below, | ||||||
| 16 | following the purchase of an eligible electric vehicle in | ||||||
| 17 | Illinois. The Agency shall accept applications and issue | ||||||
| 18 | rebates consistent with the provisions of this Act and any | ||||||
| 19 | implementing regulations adopted by the Agency. In no event | ||||||
| 20 | shall a rebate amount exceed the purchase price of the | ||||||
| 21 | vehicle. | ||||||
| 22 | (1) Beginning July 1, 2025 2022, a $2,000 $4,000 | ||||||
| 23 | rebate for eligible applicants toward the purchase of a | ||||||
| 24 | new or used an electric vehicle that is not an electric | ||||||
| 25 | motorcycle and a $1,500 rebate for the purchase of an | ||||||
| |||||||
| |||||||
| 1 | electric vehicle that is an electric motorcycle. | ||||||
| 2 | Low-income applicants are eligible for an additional | ||||||
| 3 | $2,000 rebate for new or used vehicles that are not | ||||||
| 4 | electric motorcycles. | ||||||
| 5 | (2) (Blank). Beginning July 1, 2026, a $2,000 rebate | ||||||
| 6 | for the purchase of an electric vehicle that is not an | ||||||
| 7 | electric motorcycle. | ||||||
| 8 | (3) Beginning July 1, 2028, a $1,500 rebate for | ||||||
| 9 | eligible applicants toward the purchase of a new or used | ||||||
| 10 | an electric vehicle that is not an electric motorcycle and | ||||||
| 11 | a $750 rebate for the purchase of an electric vehicle that | ||||||
| 12 | is an electric motorcycle. Low-income applicants are | ||||||
| 13 | eligible for an additional $1,500 for new or used vehicles | ||||||
| 14 | that are not electric motorcycles. | ||||||
| 15 | (4) (Blank). Beginning July 1, 2022, a $1,500 rebate | ||||||
| 16 | for the purchase of an electric vehicle that is an | ||||||
| 17 | electric motorcycle. | ||||||
| 18 | (b) To be eligible to receive a rebate, a purchaser must: | ||||||
| 19 | (1) Reside in Illinois, both at the time the vehicle | ||||||
| 20 | was purchased and at the time the rebate is issued. | ||||||
| 21 | (2) Purchase an electric vehicle in Illinois on or | ||||||
| 22 | after July 1, 2022 and be the owner of the vehicle at the | ||||||
| 23 | time the rebate is issued. Rented or leased vehicles, | ||||||
| 24 | vehicles purchased from an out-of-state dealership, and | ||||||
| 25 | vehicles delivered to or received by the purchaser | ||||||
| 26 | out-of-state are not eligible for a rebate under this Act. | ||||||

| 1 | (3) Apply for the rebate within 180 90 days after the | ||||||
| 2 | vehicle purchase date, and provide to the Agency proof of | ||||||
| 3 | residence, proof of vehicle ownership, and proof that the | ||||||
| 4 | vehicle was purchased in Illinois, including a copy of a | ||||||
| 5 | purchase agreement noting an Illinois seller. The | ||||||
| 6 | purchaser must notify the Agency of any changes in | ||||||
| 7 | residency or ownership of the vehicle that occur between | ||||||
| 8 | application for a rebate and issuance of a rebate. | ||||||
| 9 | (4) Apply for the rebate during an open rebate cycle, | ||||||
| 10 | as identified by the Agency. | ||||||
| 11 | (5) Certify that the purchaser qualifies as an | ||||||
| 12 | eligible applicant and a low-income applicant, if | ||||||
| 13 | applicable. | ||||||
| 14 | (c) The Agency shall make available in application | ||||||
| 15 | materials methods for purchasers to identify as low-income | ||||||
| 16 | applicants. The Agency shall prioritize the review of | ||||||
| 17 | qualified applications from low-income applicant purchasers | ||||||
| 18 | and award rebates to qualified purchasers accordingly. | ||||||
| 19 | (d) The purchaser must retain ownership of the vehicle for | ||||||
| 20 | a minimum of 12 consecutive months immediately after the | ||||||
| 21 | vehicle purchase date. The purchaser must continue to reside | ||||||
| 22 | in Illinois during that time frame and register the vehicle in | ||||||
| 23 | Illinois during that time frame. Rebate recipients who fail to | ||||||
| 24 | satisfy any of the above criteria will be required to | ||||||
| 25 | reimburse the Agency all or part of the original rebate amount | ||||||
| 26 | and shall notify the Agency within 60 days of failing to | ||||||
| |||||||
| |||||||
| 1 | satisfy the criteria. | ||||||
| 2 | (e) Rebates administered under this Section shall be | ||||||
| 3 | available for both new and used electric vehicles. | ||||||
| 4 | (f) A rebate administered under this Act may only be | ||||||
| 5 | applied for and awarded one time per vehicle identification | ||||||
| 6 | number. A rebate may only be applied for and awarded once per | ||||||
| 7 | purchaser in any 10-year period. | ||||||
| 8 | (g) For program auditing purposes, the Agency may request | ||||||
| 9 | from a rebate recipient additional information and | ||||||
| 10 | documentation evidencing eligibility for a rebate issued on or | ||||||
| 11 | after July 1, 2025, including copies of income tax returns | ||||||
| 12 | that corroborate the certification referenced in paragraph (5) | ||||||
| 13 | of subsection (b). If requested by the Agency, a rebate | ||||||
| 14 | recipient shall provide the information and documentation | ||||||
| 15 | within the timeframe specified in the Agency's request. If the | ||||||
| 16 | rebate recipient fails to provide the information and | ||||||
| 17 | documentation requested by the Agency by the specified | ||||||
| 18 | deadline, or if the information and documentation provided | ||||||
| 19 | evidences that the rebate recipient was not eligible for the | ||||||
| 20 | rebate or the rebate recipient fails to corroborate the | ||||||
| 21 | certification referenced in paragraph (5) of subsection (b), | ||||||
| 22 | the rebate recipient may be required to reimburse the Agency | ||||||
| 23 | all or part of the original rebate amount. | ||||||

| 1 | Sec. 40. Appropriations from the Electric Vehicle Rebate | ||||||
| 2 | Fund. | ||||||
| 3 | (a) The Agency shall estimate the amount of user fees | ||||||
| 4 | expected to be collected under Section 35 of this Act for each | ||||||
| 5 | fiscal year. User fee funds shall be deposited into and | ||||||
| 6 | distributed from the Electric Vehicle Rebate Fund in the | ||||||
| 7 | following manner: | ||||||
| 8 | (1) Through fiscal year 2023, an annual amount not to | ||||||
| 9 | exceed $225,000 may be appropriated to the Agency from the | ||||||
| 10 | Electric Vehicle Rebate Fund to pay its costs of | ||||||
| 11 | administering the programs authorized by Section 27 of | ||||||
| 12 | this Act. Beginning in fiscal year 2024 and in each fiscal | ||||||
| 13 | year thereafter, an annual amount not to exceed $600,000 | ||||||
| 14 | may be appropriated to the Agency from the Electric | ||||||
| 15 | Vehicle Rebate Fund to pay its costs of administering the | ||||||
| 16 | programs authorized by Section 27 of this Act. An amount | ||||||
| 17 | not to exceed $225,000 may be appropriated to the | ||||||
| 18 | Secretary of State from the Electric Vehicle Rebate Fund | ||||||
| 19 | to pay the Secretary of State's costs of administering the | ||||||
| 20 | programs authorized under this Act. | ||||||
| 21 | (2) In fiscal year 2022 and each fiscal year | ||||||
| 22 | thereafter, after appropriation of the amounts authorized | ||||||
| 23 | by item (1) of subsection (a) of this Section, the | ||||||
| 24 | remaining moneys estimated to be collected during each | ||||||
| 25 | fiscal year shall be appropriated. | ||||||
| 26 | (3) (Blank). | ||||||

| 1 | (4) Moneys appropriated to fund the programs | ||||||
| 2 | authorized in Sections 25 and 30 shall be expended only | ||||||
| 3 | after they have been collected and deposited into the | ||||||
| 4 | Electric Vehicle Rebate Fund. | ||||||
| 5 | (b) Amounts General Revenue Fund amounts appropriated to | ||||||
| 6 | and deposited into the Electric Vehicle Rebate Fund from the | ||||||
| 7 | General Revenue Fund, or any other fund, shall be distributed | ||||||
| 8 | from the Electric Vehicle Rebate Fund to fund the program | ||||||
| 9 | authorized in Section 27. | ||||||
