1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 11-6-12 as follows:
 
6    (65 ILCS 5/11-6-12 new)
7    Sec. 11-6-12. Reimbursement for lift-assist services.
8    (a) As used in this Section, "lift-assist service" means a
9response to an assisted living facility or nursing home
10facility by personnel of a fire department, an emergency
11response unit, or a unit of another public safety department
12providing automatic or mutual aid to a municipality, in order
13to lift a patient or other individual from the individual's
14current position to a desired position. "Lift-assist service"
15does not include lifting a patient or other individual during
16a response to a request for transportation to a health care
17facility such as a hospital or emergency room.
18    (b) Municipalities may fix, charge, and collect reasonable
19fees from an assisted living facility or nursing home facility
20for every lift-assist service after the 6th lift assist
21service provided to that assisted living facility or nursing
22home facility that year rendered by a municipal fire
23department, firefighter, emergency response unit, or public

1safety employee of a municipal department in connection with
2providing lift-assist services to a patient or other
3individual.
4    The fees may not exceed the actual personnel and equipment
5costs for all services rendered by the municipality in
6connection with providing lift-assist services to a patient or
7other individual.
 
8    Section 10. The Fire Protection District Act is amended by
9adding Section 11n as follows:
 
10    (70 ILCS 705/11n new)
11    Sec. 11n. Reimbursement for lift-assist services.
12    (a) As used in this Section, "lift-assist service" means a
13response to an assisted living facility or nursing home
14facility by personnel of a fire protection district, in order
15to lift a patient or other individual from the individual's
16current position to a desired position. "Lift-assist service"
17does not include lifting a patient or other individual during
18a response to a request for transportation to a health care
19facility such as a hospital or emergency room.
20    (b) A fire protection district may fix, charge, and
21collect reasonable fees from an assisted living facility or
22nursing home facility for every lift-assist service after the
236th lift assist service provided to that assisted living
24facility or nursing home facility that year rendered by the
