| 1 | AN ACT concerning regulation. | ||||||
| 2 | Be it enacted by the People of the State of Illinois, | ||||||
| 3 | represented in the General Assembly: | ||||||
| 4 | Section 5. The Fire Sprinkler Contractor Licensing Act is | ||||||
| 5 | amended by changing Section 62 as follows: | ||||||
| 6 | (225 ILCS 317/62) | ||||||
| 7 | Sec. 62. Unlicensed practice; violation; civil penalty. | ||||||
| 8 | (a) Any person, entity, or business that offers fire | ||||||
| 9 | sprinkler contractor services under this Act without being | ||||||
| 10 | licensed or exempt under this Act shall, in addition to any | ||||||
| 11 | other penalty provided by law, pay a civil penalty, which | ||||||
| 12 | shall be deposited into the Fire Prevention Fund, in an amount | ||||||
| 13 | not to exceed $10,000 for each offense, as determined by the | ||||||
| 14 | Office. If any person, entity, or business commits a second | ||||||
| 15 | offense within 24 months, the civil penalty shall be no less | ||||||
| 16 | than $10,000, which shall be deposited into the Fire | ||||||
| 17 | Prevention Fund. If any person, entity, or business commits | ||||||
| 18 | more than 2 offenses within 24 months, the civil penalty shall | ||||||
| 19 | be no less than $25,000, which shall be deposited into the Fire | ||||||
| 20 | Prevention Fund. The civil penalty shall be assessed by the | ||||||
| 21 | Office after a hearing is held in accordance with the | ||||||
| 22 | provisions of this Act regarding the provision of a hearing | ||||||
| 23 | for the discipline of a licensee. | ||||||

| 1 | (b) Use of the title "fire sprinkler inspector" is limited | ||||||
| 2 | to those individuals licensed under this Act. Any person who | ||||||
| 3 | practices, offers to practice, attempts to practice, or holds | ||||||
| 4 | himself or herself out to practice as a fire sprinkler | ||||||
| 5 | inspector without being licensed or exempt under this Act | ||||||
| 6 | shall, in addition to any other penalty provided by law, pay a | ||||||
| 7 | civil penalty, which shall be deposited into the Fire | ||||||
| 8 | Prevention Fund, in an amount not to exceed $10,000 for each | ||||||
| 9 | offense, as determined by the Office. If any person commits a | ||||||
| 10 | second offense within 24 months, the civil penalty shall be no | ||||||
| 11 | less than $10,000, which shall be deposited into the Fire | ||||||
| 12 | Prevention Fund. If any person commits more than 2 offenses | ||||||
| 13 | within 24 months, the civil penalty shall be no less than | ||||||
| 14 | $25,000, which shall be deposited into the Fire Prevention | ||||||
| 15 | Fund. The civil penalty shall be assessed by the Office after a | ||||||
| 16 | hearing is held in accordance with the provisions of this Act | ||||||
| 17 | regarding the provision of a hearing for the discipline of a | ||||||
| 18 | licensee. | ||||||
| 19 | (c) The Office may investigate any actual, alleged, or | ||||||
| 20 | suspected unlicensed activity. | ||||||
| 21 | (d) The civil penalty shall be paid within 60 days after | ||||||
| 22 | the effective date of the order imposing the civil penalty. | ||||||
| 23 | The order shall constitute a final judgment and may be filed | ||||||
| 24 | and execution had thereon in the same manner as any judgment | ||||||
| 25 | from any court of record. | ||||||

| 1 | Section 99. Effective date. This Act takes effect upon | ||||||
| 2 | becoming law. | ||||||
