| 1 | AN ACT concerning regulation. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the Energy | |||||||||||||||||||
| 5 | Utility Sales Agent Licensing Act. | |||||||||||||||||||
| 6 | Section 5. Definitions. As used in this Act: | |||||||||||||||||||
| 7 | "Commission" means the Illinois Commerce Commission. | |||||||||||||||||||
| 8 | "Energy utility" means any public utility, as defined in | |||||||||||||||||||
| 9 | Section 3-105 of the Public Utilities Act, that provides | |||||||||||||||||||
| 10 | electricity, natural gas, or other energy services to | |||||||||||||||||||
| 11 | consumers in this State. | |||||||||||||||||||
| 12 | "Sales agent" means any individual or entity that directly | |||||||||||||||||||
| 13 | or indirectly markets, sells, or solicits energy utility | |||||||||||||||||||
| 14 | services or products to consumers in this State. | |||||||||||||||||||
| 15 | "License" means a certificate issued by the Commission | |||||||||||||||||||
| 16 | authorizing an individual or entity to act as a sales agent for | |||||||||||||||||||
| 17 | energy utilities. | |||||||||||||||||||
| 18 | Section 10. Licensing requirement. No individual or entity | |||||||||||||||||||
| 19 | shall act as a sales agent for an energy utility in this State | |||||||||||||||||||
| 20 | without first obtaining a license from the Commission. All | |||||||||||||||||||
| 21 | licensed sales agents must carry his or her license during all | |||||||||||||||||||
| 22 | sales activities and provide proof of licensure upon request | |||||||||||||||||||

| 1 | by consumers or the Commission. | ||||||
| 2 | Section 15. Application for license. Within 90 days of the | ||||||
| 3 | effective date of this Act, the Commission shall create an | ||||||
| 4 | application form for a sales agent license and make the form | ||||||
| 5 | available on the Commission's website. Once issued by the | ||||||
| 6 | Commission, a license is valid for a period of 2 years from the | ||||||
| 7 | date of issuance. Licensed sales agents shall apply for | ||||||
| 8 | renewal at least 30 days prior to the expiration of his or her | ||||||
| 9 | active license. The Commission may charge a reasonable fee for | ||||||
| 10 | processing the application. Fees collected under this Act | ||||||
| 11 | shall be deposited into the Public Utility Fund. | ||||||
| 12 | Section 20. Training and continuing education. All | ||||||
| 13 | applicants shall complete training, as determined and | ||||||
| 14 | administered by the Commission, prior to applying for a new | ||||||
| 15 | license or renewal. All applicants must provide proof of | ||||||
| 16 | training prior to entering the application process. | ||||||
| 17 | Section 25. Penalties. The Commission may suspend, revoke, | ||||||
| 18 | or refuse to renew a license for any violations of this Act or | ||||||
| 19 | any rules adopted under this Act. Any individual or entity | ||||||
| 20 | that acts as a sales agent for an energy utility without a | ||||||
| 21 | license is subject to a civil penalty of up to $5,000 for each | ||||||
| 22 | violation. Penalties collected under this Section shall be | ||||||
| 23 | deposited into the Public Utility Fund. | ||||||

| 1 | Section 30. Rulemaking authority. The Commission shall | ||||||
| 2 | adopt any rules necessary to implement and enforce this Act in | ||||||
| 3 | accordance with the Public Utilities Act and the Illinois | ||||||
| 4 | Administrative Procedure Act. | ||||||
