SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Illinois Data Center Energy and Water Reporting Act. Defines terms. Provides that, beginning January 1, 2026, all data centers operating within the State shall annually report the data center's energy and water consumption to the Illinois Power Agency for the preceding calendar year. Sets forth requirements for the content of the report. Provides that reports shall be submitted to the Agency no later than March 31 of each year. Sets forth provisions concerning data confidentiality and public access to information and the enforcement of the Act and penalties. Provides that the Agency shall conduct a comprehensive study on the impact that data centers in the State are having on rate-paying customers. Sets forth requirements for the content of the study. Provides that the Agency shall submit a report detailing the findings of the study to the General Assembly and the Governor no later than 12 months after the effective date of the Act. Sets forth rulemaking provisions for the Agency. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Illinois Data Center Energy and Water Reporting Act.
 
6    Section 5. Purpose. The purpose of this Act is to ensure
7transparency regarding the environmental impacts of data
8centers operating within the State by requiring the disclosure
9of energy and water usage data to the Illinois Power Agency.
 
10    Section 10. Definitions.
11    "Agency" means the Illinois Power Agency.
12    "Data center" means a facility used to house computer
13systems and associated components, including
14telecommunications and storage systems, where the primary
15function is the storage, management, and dissemination of
16data.
17    "Energy consumption" means the total amount of electricity
18or other forms of energy consumed by a data center, measured in
19kilowatt-hours.
20    "Water consumption" means the total amount of water
21consumed by a data center, including water used for cooling,
22measured in gallons.

1    Section 15. Reporting requirements.
2    (a) Beginning January 1, 2026, all data centers operating
3within this State shall annually report the data center's
4energy and water consumption to the Agency for the preceding
5calendar year.
6    (b) The report shall include:
7        (1) the total energy consumption for the previous
8    calendar year, broken down by month and specifying the
9    energy source;
10        (2) total water consumption for the previous calendar
11    year, broken down by month and specifying whether the
12    consumption was for cooling or another application; and
13        (3) any measures undertaken the previous calendar year
14    to improve energy efficiency or reduce water usage.
15    (c) Reports shall be submitted to the Agency no later than
16March 31 of each year.
 
17    Section 20. Data confidentiality and public access.
18    (a) Proprietary information may be exempt from public
19disclosure. Aggregated and anonymized data shall be made
20available to the public.
21    (b) The Agency shall publish an annual report summarizing
22statewide energy and water consumption trends in data centers,
23including, but not limited to, legislative recommendations to
24address identified issues.

1    Section 25. Enforcement and penalties.
2    (a) Data centers that fail to comply with the reporting
3requirements under this Act may be subject to fines of up to
4$10,000 per violation.
5    (b) All funds collected under this Section shall be
6deposited into the Energy Efficiency Trust Fund.
 
7    Section 30. Data center impact study.
8    (a) The Agency shall conduct a comprehensive study on the
9impact that data centers in this State are having on
10rate-paying customers.
11    (b) The study shall include, but is not limited to, the
12following:
13        (1) the energy consumption of data centers and its
14    effects on overall electricity demand in this State;
15        (2) the extent to which data centers contribute to
16    electricity rate changes for residential, commercial, and
17    industrial customers;
18        (3) the environmental impact of data centers in this
19    State; and
20        (4) potential legislation to mitigate any negative
21    impacts of data centers on rate-paying customers.
22    (c) In conducting the study, the Agency shall:
23        (1) consult with stakeholders, including, but not
24    limited to, public utilities, data center operators,

1    consumer advocacy groups, and environmental organizations;
2        (2) analyze data from public utilities and other
3    relevant sources to assess the energy consumption and rate
4    impacts associated with data centers; and
5        (3) consider best practices from other states in
6    managing the energy and rate impacts of data centers.
7    (d) The Agency shall submit a report detailing the
8findings of the study to the General Assembly and the Governor
9no later than 12 months after the effective date of this Act.
 
10    Section 35. Rulemaking authority. The Illinois Power
11Agency shall have the authority to adopt rules necessary to
12implement the provisions of this Act.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.
