| 1 | AN ACT concerning elections. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 5. The Election Code is amended by changing | |||||||||||||||||||
| 5 | Section 29-9 as follows: | |||||||||||||||||||
| 6 | (10 ILCS 5/29-9) (from Ch. 46, par. 29-9) | |||||||||||||||||||
| 7 | Sec. 29-9. Unlawful observation of voting; photographs of | |||||||||||||||||||
| 8 | ballots. | |||||||||||||||||||
| 9 | (a) Except as permitted by this Code, any person who | |||||||||||||||||||
| 10 | knowingly marks his ballot or casts his vote on a voting | |||||||||||||||||||
| 11 | machine or voting device so that it can be observed by another | |||||||||||||||||||
| 12 | person, and any person who knowingly observes another person | |||||||||||||||||||
| 13 | lawfully marking a ballot or lawfully casting his vote on a | |||||||||||||||||||
| 14 | voting machine or voting device, shall be guilty of a Class 4 | |||||||||||||||||||
| 15 | felony. Nothing in this subsection prohibits a person from | |||||||||||||||||||
| 16 | photographing his or her own ballot at any time during the | |||||||||||||||||||
| 17 | voting process or from viewing a photograph of a completed or | |||||||||||||||||||
| 18 | partially completed ballot. | |||||||||||||||||||
| 19 | (b) Any person who gives, promises to give, or receives | |||||||||||||||||||
| 20 | any money or other valuable consideration in connection with | |||||||||||||||||||
| 21 | the dissemination or viewing of a photograph of a completed or | |||||||||||||||||||
| 22 | partially completed ballot shall be guilty of a Class 4 | |||||||||||||||||||
| 23 | felony. | |||||||||||||||||||
