| 1 | | AN ACT concerning business. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Consumer Fraud and Deceptive Business |
| 5 | | Practices Act is amended by adding Section 2HHHH as follows: |
| 6 | | (815 ILCS 505/2HHHH new) |
| 7 | | Sec. 2HHHH. Social clubs; delinquent members. |
| 8 | | (a) As used in this Section, "social club" means a private |
| 9 | | establishment that is the premises of a formal organization of |
| 10 | | members for pleasure, recreation, and other purposes. "Social |
| 11 | | club" does not include a fitness center or a community pool. |
| 12 | | (b) A social club shall not charge a member who is |
| 13 | | delinquent or in poor standing with the club for the time the |
| 14 | | member is not allowed in the club or is unable to access the |
| 15 | | club's services. A contract that violates this subsection is |
| 16 | | void and unenforceable. |
| 17 | | (c) This Section applies to all contracts that are entered |
| 18 | | into, amended, renewed, or extended on or after the effective |
| 19 | | date of this amendatory Act of the 104th General Assembly. |
| 20 | | (d) A violation of this Section constitutes an unlawful |
| 21 | | practice within the meaning of this Act. |
| 22 | | Section 99. Effective date. This Act takes effect upon |
