| 1 | AN ACT concerning local government. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the Local | |||||||||||||||||||
| 5 | Government Chairperson Term Limit Review Act. | |||||||||||||||||||
| 6 | Section 5. Definitions. As used in this Act: | |||||||||||||||||||
| 7 | "Chairperson" means a chairperson, president, or | |||||||||||||||||||
| 8 | executive, by whatever name, of the governing board of a | |||||||||||||||||||
| 9 | governmental unit. | |||||||||||||||||||
| 10 | "Governmental unit" means a unit of local government or | |||||||||||||||||||
| 11 | school district. | |||||||||||||||||||
| 12 | Section 10. Home rule. A home rule unit may not regulate | |||||||||||||||||||
| 13 | term limits in a manner inconsistent with this Act. This Act is | |||||||||||||||||||
| 14 | a limitation under subsection (i) of Section 6 of Article VII | |||||||||||||||||||
| 15 | of the Illinois Constitution on the concurrent exercise by | |||||||||||||||||||
| 16 | home rule units of powers and functions exercised by the | |||||||||||||||||||
| 17 | State. | |||||||||||||||||||
| 18 | Section 15. Two-year review of term limits for | |||||||||||||||||||
| 19 | chairpersons. | |||||||||||||||||||
| 20 | (a) No later than December 31, 2025, and no less than every | |||||||||||||||||||
| 21 | 2 years thereafter, a governmental unit that is governed by an | |||||||||||||||||||
| |||||||
| |||||||
| 1 | elected governing body that has not enacted term limits for | ||||||
| 2 | the board's chairperson by ordinance or resolution shall | ||||||
| 3 | consider and decide, by verbal or written vote, ordinance, | ||||||
| 4 | resolution, or referendum of the electors of the governmental | ||||||
| 5 | unit, whether to impose term limits for the chairperson of the | ||||||
| 6 | governing body. | ||||||
| 7 | (b) This Section does not apply to governing or | ||||||
| 8 | administrative bodies whose members are appointed by a board | ||||||
| 9 | of a governmental unit or by a government official. | ||||||
| 10 | Section 20. Review of term limit policy before electing | ||||||
| 11 | chairperson. | ||||||
| 12 | (a) If a governmental unit has a term limit policy for the | ||||||
| 13 | chairperson of its governing body, before a person may be | ||||||
| 14 | elected chairperson, the governmental unit's clerk or | ||||||
| 15 | secretary shall determine which members of the governing body | ||||||
| 16 | are eligible to serve as chairperson of the governing body | ||||||
| 17 | based upon the term limit policy. The clerk or secretary shall | ||||||
| 18 | submit an eligibility report to the governing body listing | ||||||
| 19 | those members who are eligible and ineligible before the | ||||||
| 20 | meeting at which the chairperson is to be elected. | ||||||
| 21 | (b) Only after the governing body of a governmental unit | ||||||
| 22 | receives the eligibility report may the governing body elect a | ||||||
| 23 | chairperson. | ||||||
| 24 | Section 99. Effective date. This Act takes effect upon | ||||||
| 25 | becoming law. | ||||||
