PART 554 SERVICES TO POTENTIALLY ELIGIBLE STUDENTS

Section 554.10  Potentially Eligible Students

 

Potentially eligible students are individuals who can provide supporting evidence that they meet the definition of "student with a disability" at 89 Ill. Adm. Code 521.20.

 

Section 554.20  Service Options

 

a)         Potentially eligible students shall receive one or more pre-employment transition services as defined in 89 Ill. Adm. Code 521.20, including:  job exploration counseling; work-based learning experiences; counseling on opportunities for enrollment in postsecondary educational programs; workplace readiness training to develop social and independent living skills; and instruction in self-advocacy, including peer mentoring.

 

b)         Potentially eligible students shall not receive any individualized vocational rehabilitation services.  Any potentially eligible individual seeking to receive individualized vocational rehabilitation services must apply for vocational rehabilitation services and be certified as eligible (see Section 554.60).

 

Section 554.30  Service Agreement

 

Potentially eligible students shall receive a written agreement, stating the specific pre-employment transition services they will receive and the name of the entity that will provide the services.

 

Section 554.40  Parent or Guardian Signature

 

Written consent of a parent or guardian is required to participate in pre-employment transition services for a potentially eligible student who:

 

a)         is under 18 years of age, unless emancipated in accordance with the Emancipation of Mature Minors Act [750 ILCS 30]; or

 

b)         is a person for whom a legal guardian has been appointed.

 

Section 554.50  Exit from Services to Potentially Eligible Students

 

a)         A potentially eligible student shall no longer receive services under this Part if the student is no longer a student or reaches the age of 22.

 

b)         A potentially eligible student may choose to terminate services at any time.  Written consent of a parent or guardian is required to terminate services for students under 18 years of age or for whom a legal guardian has been appointed.

 

Section 554.60  Transfer to Eligibility Status in the Vocational Rehabilitation Program

 

A potentially eligible student may choose to apply for the Vocational Rehabilitation Program under 89 Ill. Adm. Code 557 and be evaluated for program eligibility under 89 Ill. Adm. Code 553.  During the time the potentially eligible student is being evaluated for eligibility, the student may continue to receive pre-employment transition services under this Part.
