SUBPART A: PROVISIONS APPLICABLE TO INDIVIDUAL AND GROUP POLICIES
Section 2001.1 Applicability
a) Unless otherwise provided, this Subpart applies to all individual and group policies and certificates of accident and health insurance, dental service plans, voluntary health services plans, health care plans, and limited health care plans, including HMO point of service plans and limited point of service products, except to the extent that a policy, certificate, or coverage provides excepted benefits. Sections 2001.3 and 2001.13 apply to all individual and group policies, certificates, and coverage regardless of whether they provide excepted benefits.
b) Sections 2001.2 and 2001.8 also apply to a self-funded group health plan for a governmental unit under the State Employees Group Insurance Act of 1971 [5 ILCS 375], the Counties Code [5 ILCS 55], the Illinois Municipal Code [65 ILCS 5], or the School Code [5 ILCS 105].
c) This Part does not apply to coverage through the medical assistance program under Article V of the Illinois Public Aid Code [305 ILCS 5], the Children's Health Insurance Program Act [215 ILCS 106], Medicare Advantage, Medicare Part D, or any Medicare demonstration program.
