    AN ACT to amend the Public Water District Act by changing
Section 26.

    Be it enacted by the People of  the  State  of  Illinois,
represented in the General Assembly:

    Section  5.   The Public Water District Act is amended by
changing Section 26 as follows:

    (70 ILCS 3705/26) (from Ch. 111 2/3, par. 212.1)
    Sec. 26. Annexation. Any territory which is contiguous to
a public water district organized under this Act and which is
not included in any public water district may be  annexed  to
such  contiguous public water district in the manner provided
by this Section.
    A petition, signed by  two-thirds  of  the  legal  voters
residing  in  the territory sought to be annexed, or if there
are no legal voters in  the  territory,  a  majority  of  the
owners  of record of the land in the territory, and addressed
to the circuit court of the county in which the public  water
district   to  which  annexation  is  sought  was  organized,
requesting that the territory described in  the  petition  be
annexed  to such public water district, may be filed with the
clerk of such court. The clerk of such court shall  thereupon
present  such  petition  to the court which shall set a time,
place and date for a hearing thereon, which date shall be not
less than 20 nor  more  than  45  days  after  the  date  the
petition  was filed. The court shall give notice of the time,
place and date of the hearing by publication in one  or  more
newspapers published in the district, and if there is no such
newspaper,  in one or more newspapers published in the county
and having a general  circulation  within  the  public  water
district  and  within  the  territory  sought  to  be annexed
thereto, which publication shall be made  at  least  15  days
prior to the date set for the hearing.

    Section  99.  Effective date.  This Act takes effect upon
becoming law.
