    AN ACT in relation to criminal law.

    Be it enacted by the People of  the  State  of  Illinois,
represented in the General Assembly:

    Section  5.  The  Criminal  Code  of  1961  is amended by
adding Section 12-4.10 as follows:

    (720 ILCS 5/12-4.10 new)
    Sec. 12-4.10.  Endangering the  life  and  health  of  an
emergency service provider.
    (a)  A person commits the offense of endangering the life
and  health  of an emergency service provider if an emergency
service  provider  experiences  death,  great  bodily   harm,
disability,  or  disfigurement  as  a  result  of  entering a
structure containing a clandestine drug  laboratory  designed
or  intended  to  produce an unlawful controlled substance or
designed or intended  to  produce  ingredients  used  in  the
manufacture of an unlawful controlled substance.
    (b)  In this Section:
    "Emergency  service  provider"  means  a peace officer, a
firefighter, an emergency  medical  technician-ambulance,  an
emergency   medical-technician-intermediate,   an   emergency
medical  technician-paramedic,  an  ambulance driver or other
medical or first aid personnel.
    "Structure" means any house,  apartment  building,  shop,
barn,   warehouse,  building,  vessel,  railroad  car,  cargo
container, motor vehicle, housecar, trailer,  trailer  coach,
camper,   mine,  floating  home,  watercraft,  any  structure
capable of holding  a  clandestine  laboratory  or  any  real
property.
    (c)  Sentence.   Endangering  the  life  and health of an
emergency service provider is a Class X felony.
    Section 99.  Effective date.  This Act takes effect  upon
becoming law.
