    AN ACT concerning regulation.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 5. The Illinois Act on the Aging is amended by
changing Section 3 and by adding Section 3.11 as follows:

    Sec. 3. As used in this Act, unless the context otherwise
requires, the terms specified in Sections 3.01 through 3.11
3.10 have the meanings ascribed to them in those Sections.

    (20 ILCS 105/3.11 new)
    Sec. 3.11. Greatest social need. For the purposes of 89
Ill. Adm. Code 210.50, "greatest social need" means the need
caused by noneconomic factors that restrict an individual's
ability to perform normal daily tasks or that threaten his or
her capacity to live independently. These factors include
physical or mental disability, language barriers, and cultural
or social isolation caused by, among other things, racial and
ethnic status, sexual orientation, gender identity, gender
expression, or HIV status.
 
    Section 10. The Assisted Living and Shared Housing Act is
amended by adding Section 97 as follows:
 
    (210 ILCS 9/97 new)
    Sec. 97. Unlawful discrimination. No resident shall be
subjected to unlawful discrimination as defined in Section
1-103 of the Illinois Human Rights Act by any owner, licensee,
administrator, employee, or agent of an assisted living
establishment. Unlawful discrimination does not include an
action by any owner, licensee, administrator, employee, or
agent of an assisted living establishment that is required by
this Act or rules adopted under this Act.
 
    Section 99. Effective date. This Act takes effect upon
becoming law.
