Short description: 
CRIM CD-DEATH PENALTY                                                      

Synopsis of Bill as introduced:
        Amends the Criminal Code of 1961  in  relation  to  first  degree      
   murder.  Provides that if any juror concludes that there is a residual      
   doubt concerning the defendant's guilt, that juror shall so advise the      
   court and the  court  shall  sentence  the  defendant  to  a  term  of      
   imprisonment.  Provides  that  a  defendant  charged with first degree      
   murder is not eligible for a sentence of death when: (1)  identity  is      
   the  issue  in  the  case  and  the  court determines that the State's      
   ability to meet its burden to prove  the  defendant  guilty  beyond  a      
   reasonable  doubt  depends upon the testimony of a sole eyewitness who      
   will testify that the defendant is the perpetrator of the  offense  or      
   (2)  the defendant's case has previously been tried by the court and a      
   jury and, following  the  trial,  the  jury  was  unable  to  reach  a      
   unanimous verdict on the defendant's guilt of the offense.
