Short description: 
PEST CONTROL-PENALTIES                                                     

Synopsis of Bill as introduced:
        Amends the Structural Pest Control Act.  Provides that  a  person      
   convicted  of  a second or subsequent violation is guilty of a Class 4      
   felony.  Amends the Illinois Pesticide Act.   Defines  "retailer"  and      
   "wholesaler".   Changes  the  criminal penalties for violations of the      
   Act by a retailer or a wholesaler.  Effective immediately.                  
        HOUSE AMENDMENT NO. 1.                                                 
          Deletes reference to:                                                
          415 ILCS 60/4                                                        
        Deletes  everything  after  the  enacting  clause.   Amends   the      
   Structural  Pest  Control  Act.  Provides that a person convicted of a      
   second or  subsequent  violation  of  specific  provisions  concerning      
   licensure  requirements  is  guilty  of  a  Class 4 felony. Amends the      
   Illinois Pesticide Act. Provides criminal penalties for  retailers  or      
   wholesalers  distributing  or  selling a pesticide not registered with      
   the United States Environmental Protection  Agency  and  the  Illinois      
   Department of Agriculture. Effective immediately.                           
          FISCAL NOTE (Department of Public Health)                            
          HB 4942 will not create a fiscal impact on the DepartMENT.
