MOLARO. 725 ILCS 5/122-1 from Ch. 38, par. 122-1 Amends the Code of Criminal Procedure of 1963. Provides that a post-conviction hearing proceeding in a capital case may be commenced at any time after the defendant's conviction if there is newly discovered evidence not available to the defendant at the time of the proceeding that resulted in his or her conviction and the evidence establishes the defendant's innocence. Effective immediately.
