FRITCHEY-SCHOENBERG-GARRETT-DART-FRANKS, MILLER, 
   MCAULIFFE AND OSTERMAN.

   New Act                                                                     
   815 ILCS 505/2Z           from Ch. 121 1/2, par. 262Z                       

        Creates the Facsimile and Electronic Mail Commercial Solicitation      
   Act and amends the Consumer Fraud  and  Deceptive  Business  Practices      
   Act.  Prohibits  a  person or entity conducting business in this State      
   from sending a fax or e-mail  consisting  of  unsolicited  advertising      
   material  unless  it  includes a toll-free telephone number or address      
   that may be used to notify the sender not to send further  unsolicited      
   advertising  by  fax  or  e-mail,  and prohibits sending such a fax or      
   e-mail to a person after receiving such a notice from the  person.  In      
   the  case  of e-mail, applies when the unsolicited e-mail is delivered      
   to an Illinois resident via  an  electronic  mail  service  provider's      
   service  or equipment located in this State. Requires the subject line      
   of an unsolicited advertising e-mail message to include "ADV:" as  the      
   first  4  characters  (or  "ADV:ADLT"  as the first 8 characters if it      
   concerns goods or services that may only be viewed, purchased, rented,      
   leased, or held in possession by those 18 years  of  age  and  older).      
   Provides that the new provisions are inoperative on and after the date      
   that  federal law is enacted that prohibits or otherwise regulates the      
   transmission of  unsolicited  advertising  by  e-mail.  Provides  that      
   violation  is  a  Class  C  misdemeanor  and  constitutes  an unlawful      
   practice under the Consumer Fraud  and  Deceptive  Business  Practices      
   Act.                                                                        
          HOUSING AFFORDABILITY NOTE (Housing Development Authority)           
          There would be no fiscal effect on a single-family residence.        
          CORRECTIONAL NOTE (Department of Corrections)                        
          There would be no fiscal impact or impact on the corrections         
          population from HB 5580.
