LEITCH.

(TROTTER-CULLERTON-PETKA)

   720 ILCS 5/7-13.5 new                                                       

        Amends  the  Criminal  Code  of  1961.   Creates   a   rebuttable      
   presumption  that  action  or  possession  undertaken  by a commercial      
   airline pilot, navigator, engineer, or flight attendant, on  or  after      
   September  11,  2001, is necessary to avoid a public or private injury      
   greater than the injury that might reasonably result from his  or  her      
   own  conduct,  if the conduct or possession is reasonably necessary to      
   provide for the safety of a commercial aircraft. Provides that in  the      
   case  of  a  person  who  flies  across  state  lines,  no Illinois or      
   municipal licenses for carrying  concealed  weapons  are  required  to      
   establish this defense. Effective immediately.
