MCGUIRE-GARRETT-MCKEON AND FEIGENHOLTZ.

   210 ILCS 40/10.1 new                                                        
   210 ILCS 45/2-213                                                           

        Amends the Life Care Facilities Act and  the  Nursing  Home  Care      
   Act.   Provides  that  the  facilities  licensed  under  the Acts must      
   document  evidence  of  vaccination  for  influenza  and  pneumococcal      
   disease for each resident age 60 and over, unless the  vaccination  is      
   medically contraindicated or the resident has refused the vaccination.      
   Effective immediately.                                                      
          FISCAL NOTE (Department of Public Health)                            
          There is no impact on DPH, and the Department cannot determine       
          the impact upon the residents of the facilities affected by          
          HB 661. The Department of Public Aid may be the appropriate          
          agency to determine the fiscal impact.                               
        HOUSE AMENDMENT NO. 1.                                                 
        Further amends the Life Care Facilities Act and the Nursing  Home      
   Care  Act.   Deletes provisions limiting the required documentation of      
   evidence of annual vaccination against influenza to  persons  who  are      
   age  60  or over.  Provides that influenza vaccines for residents over      
   60 years of age do not need to be completed by November 30 of a  given      
   year  if  the vaccine supplies were not available before November 1 of      
   that year.  Provides that a resident admitted between November 30  and      
   February  1  does  not need to receive an influenza vaccination if the      
   vaccine is medically  contraindicated  or  the  resident  refuses  the      
   vaccine.   Provides  that  if  the  Advisory Committee on Immunization      
   Practices of the Centers for Disease Control and Prevention determines      
   that dates of administration other than the ones provided  under  this      
   amendatory Act of the 92nd General Assembly are optimal to protect the      
   health  of  residents, the Department of Public Health may adopt rules      
   to mandate vaccinations at times determined by that  committee  rather      
   than the times provided under this amendatory Act.
