 1        AN ACT concerning higher education student assistance.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The Higher Education Student Assistance Act
 5    is amended by changing Section 45 as follows:

 6        (110 ILCS 947/45)
 7        Sec. 45. Illinois National Guard grant program.
 8        (a)  As used in this Section:
 9        "State-controlled   State   controlled   university    or
10    community   college"   means  those  institutions  under  the
11    administration of  the  Chicago  State  University  Board  of
12    Trustees,  the Eastern Illinois University Board of Trustees,
13    the  Governors  State  University  Board  of  Trustees,   the
14    Illinois State University Board of Trustees, the Northeastern
15    Illinois  University Board of Trustees, the Northern Illinois
16    University Board of Trustees, the Western Illinois University
17    Board of Trustees,  Southern  Illinois  University  Board  of
18    Trustees,  University  of  Illinois Board of Trustees, or the
19    Illinois Community College Board.
20        "Tuition and fees" shall not  include  expenses  for  any
21    sectarian  or denominational instruction, the construction or
22    maintenance of sectarian or denominational facilities, or any
23    other sectarian or denominational purposes or activity.
24        "Fees" means matriculation, graduation,  activity,  term,
25    or  incidental  fees. Exemption shall not be granted from any
26    other  fees,  including  book  rental,  service,  laboratory,
27    supply,  and  union  building  fees,  hospital  and   medical
28    insurance  fees,  and  any fees established for the operation
29    and maintenance of buildings, the income of which is  pledged
30    to  the  payment of interest and principal on bonds issued by
31    the governing board of any university or community college.

 1        (b)  Any enlisted person or person having any one of  the
 2    ranks  from  a  warrant officer through a field grade officer
 3    any company grade officer, including warrant officers,  First
 4    and Second Lieutenants, and Captains in the Illinois Army and
 5    Air National Guard, who has served at least 6 months one year
 6    in   the  Illinois  National  Guard  and  who  possesses  all
 7    necessary entrance requirements shall, upon  application  and
 8    proper  proof,  be  awarded  a  grant to the State-controlled
 9    university  or  community  college  of  his  or  her  choice,
10    consisting of exemption from tuition and fees  for  not  more
11    than  the  equivalent  of  4 years of full-time enrollment in
12    relation  to  his  or   her   course   of   study   at   that
13    State-controlled  State  controlled  university  or community
14    college while he or she is a member of the Illinois  National
15    Guard.   If  the  recipient  of  any grant awarded under this
16    Section ceases to be a  member of the Illinois National Guard
17    while enrolled in a course of study  under  that  grant,  the
18    grant  shall  be  terminated as of the date membership in the
19    Illinois National Guard ended, and  the  recipient  shall  be
20    permitted  to  complete the school term in which he or she is
21    then enrolled only upon payment of  tuition  and  other  fees
22    allocable  to  the  part  of the term then remaining.  If the
23    recipient of a grant fails to complete his  or  her  military
24    service   obligations   or   requirements   for  satisfactory
25    participation,  the  Department  of  Military  Affairs  shall
26    require the recipient  to  repay  the  amount  of  the  grant
27    received,  prorated  according to the fraction of the service
28    obligation not  completed,  and,  if  applicable,  reasonable
29    collection  fees.  The  Department  of  Military  Affairs  is
30    authorized  to  establish  rules  relating  to its collection
31    activities for repayment  of  a  grant  under  this  Section.
32    Unsatisfactory    participation    shall    be   defined   in
33    administrative procedures  published  by  the  Department  of
34    Military Affairs.  All of these repayments shall be deposited

 1    into the National Guard Grant Fund.  The National Guard Grant
 2    Fund is created as a special fund in the State treasury.  All
 3    money in the National Guard Grant Fund shall be used, subject
 4    to  appropriation,  by the Department of Military Affairs for
 5    the purposes of this Section.
 6        A grant awarded under this Section shall be considered an
 7    entitlement  which  a  the  State-controlled  university   or
 8    community  college  in  which  a the holder is enrolled shall
 9    honor  without  any  condition  other   than   the   holder's
10    maintenance  of  minimum  grade  levels  and  a  satisfactory
11    student  loan  repayment record pursuant to subsection (c) of
12    Section 20 of this Act.
13        (c)  Subject  to  a  separate  appropriation   for   such
14    purposes, the Commission may reimburse a the State-controlled
15    university or community college for grants authorized by this
16    Section.

18        Section   95.  The State Finance Act is amended by adding
19    Section 5.545 as follows:

21        Sec. 5.545.  The National Guard Grant Fund.

22        Section 99.  Effective date.  This Act  takes  effect  on
23    January 1, 2002.
