1 AN ACT with regard to schools.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The School Code is amended by changing
5 Section 10-22.40 as follows:
6 (105 ILCS 5/10-22.40) (from Ch. 122, par. 10-22.40)
7 Sec. 10-22.40. Membership dues. To pay State and
8 national association membership dues to school associations
9 which benefit students by participation or accreditation.
10 Any association subject to Article 23 of this Act must be in
11 current compliance with the reporting requirements of Section
12 23-6 in order to qualify as a recipient of membership dues
13 under this Section. No dues may be paid to any association
14 which has as one of its purposes providing for athletic and
15 other competition among schools and students unless that
16 association:
17 A. permits a post audit by the Auditor General under the
18 Illinois State Auditing Act;
19 B. submits an annual report to the State Board of
20 Education dealing with trends in female participation in
21 athletic competition, including the numbers of female and
22 male participants from each member school and details on
23 programs by the association to increase female participation;
24 and
25 C. is either subject to, or voluntarily complies with,
26 the public access provisions set forth for State agencies in
27 Sections 3 and 4 of The State Records Act; and.
28 D. does not discriminate against any type or category of
29 physician licensed under the Medical Practice Act of 1987 for
30 certifying the physical fitness of participants in athletic
31 competition.

2 Section 99. Effective date. This Act takes effect upon
3 becoming law.
