1 AN ACT concerning environmental protection.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended
5 by changing Section 39.4 as follows:
6 (415 ILCS 5/39.4) (from Ch. 111 1/2, par. 1039.4)
7 Sec. 39.4. Agrichemical facility or lawncare containment
8 permit endorsement.
9 (a) Upon receipt of a joint application transmitted from
10 the Department of Agriculture for an agrichemical facility
11 construction or operation permit or a lawncare containment
12 permit, the Agency may provide a written endorsement of the
13 permit to be issued by the Department for the such
14 agrichemical facility or lawncare wash water containment
15 area. The Agency's endorsement may be provided at any time
16 prior to final action by the Department regarding the subject
17 permit.
18 (b) For all purposes of this Act, an agrichemical
19 facility permit or lawncare containment permit endorsed by
20 the Agency pursuant to this Section shall be deemed to be a
21 permit issued by the Agency pursuant to subsection (b) of
22 Section 9 and subsection (b) of Section 12 of this Act. An
23 agrichemical facility or a lawncare wash water containment
24 area remains subject to all applicable permit requirements
25 under this Act if the Department of Agriculture's
26 agrichemical facility permit or lawncare containment permit
27 has not been endorsed pursuant to subsection (a) of this
28 Section.
29 (c) An agrichemical facility permit or a lawncare
30 containment permit endorsed by the Agency shall not be
31 subject to the annual fee provisions of Section 9.6 of this
