1 AN ACT concerning surrogate decision makers.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Health Care Surrogate Act is amended by
5 changing Section 60 as follows:
6 (755 ILCS 40/60)
7 Sec. 60. Health care surrogate; specific mental health
8 services.
9 (a) In this Section, "specific mental health services"
10 means the administration of authorized involuntary treatment
11 as defined in Section 1-121.5 of the Mental Health and
12 Developmental Disabilities Code or admission to a mental
13 health facility as defined in Section 1-114 of that Code.
14 (b) A surrogate decision maker, other than a court
15 appointed guardian, may not consent to specific mental health
16 services for an adult patient. A surrogate decision maker
17 may, however, petition for the provision of specific mental
18 health services pursuant to the Mental Health and
19 Developmental Disabilities Code.
20 (c) This Section does not grant a court-appointed
21 guardian any additional authority to consent to specific
22 mental health services than is permitted under by the Mental
23 Health and Developmental Disabilities Code.
