1 AN ACT concerning insurance.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Insurance Code is amended by
5 adding Section 356z.2 as follows:
6 (215 ILCS 5/356z.2 new)
7 Sec. 356z.2. Preexisting condition; successor coverage.
8 A policy of accident and health insurance issued after the
9 effective date of this amendatory act of the 92nd General
10 Assembly may not exclude coverage based upon a preexisting
11 condition if:
12 (1) the policy provides coverage to a person who
13 was insured by the issuer under another policy; and
14 (2) there is no period of time between the
15 cessation of coverage under the other policy and the
16 inception of coverage under the policy being issued.
17 Section 99. Effective date. This Act takes effect upon
18 becoming law.
