1 AN ACT concerning elections.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Election Code is amended by adding
5 Section 29-19.5 as follows:
6 (10 ILCS 5/29-19.5 new)
7 Sec. 29-19.5. False designation of incumbency. Any
8 person who uses in any campaign material, including, but not
9 limited to, radio advertisements, telephone advertisements,
10 newspaper advertisements, circulars, cards, stationary, or
11 electronic media, the words "incumbent," "re-elect," or
12 "re-election" or otherwise indicates that the candidate for
13 public office is the incumbent officeholder when the person
14 knows that the candidate is not the incumbent officeholder is
15 guilty of a petty offense. The penalty is a fine of not more
16 than $500.
17 Section 99. Effective date. This Act takes effect upon
18 becoming law.
