 1                    AMENDMENT TO HOUSE BILL 2091

 2        AMENDMENT NO.     .  Amend House Bill 2091  by  replacing
 3    the title with the following:
 4        "AN ACT in relation to health."; and

 5    by  replacing  everything  after the enacting clause with the
 6    following:

 7        "Section 5. The Department of Public  Health  Powers  and
 8    Duties  Law  of  the Civil Administrative Code of Illinois is
 9    amended  by  changing  Sections  2310-425  and  2310-430   as
10    follows:

11        (20 ILCS 2310/2310-425) (was 20 ILCS 2310/55.66)
12        Sec. 2310-425.  Health care summary for women.
13        (a)  From  funds made available from the General Assembly
14    for this purpose,  the  Department  shall  publish  in  plain
15    language,  in  both  an  English  and  a  Spanish  version, a
16    pamphlet providing  information  regarding  health  care  for
17    women which shall include the following:
18             (1)  A  summary  of  the various medical conditions,
19        including cancer, lead  poisoning,  sexually  transmitted
20        diseases,  endometriosis,  or  other  similar diseases or
21        conditions widely affecting women's reproductive  health,

 1        that may require a hysterectomy or other treatment.
 2             (2)  A  summary  of  the  recommended  schedule  and
 3        indications    for   physical   examinations,   including
 4        screening for lead poisoning and "pap  smears"  or  other
 5        tests designed to detect medical conditions of the uterus
 6        and  other  reproductive  organs.  The summary shall also
 7        include information regarding the health risks associated
 8        with the conditions and the reasons  for  conducting  the
 9        exam   and  recommended  screening  or  tests,  including
10        information  regarding  the  risks  of  breast-feeding  a
11        newborn infant by a mother whose level of lead  poisoning
12        is identified as posing a risk to a nursing infant.
13             (3)  A   summary  of  the  widely  accepted  medical
14        treatments, including viable alternatives,  that  may  be
15        prescribed   for  the  medical  conditions  specified  in
16        paragraph (1).
17        (b)  In  developing  the  summary  the  Department  shall
18    consult with the Illinois State Medical Society and  consumer
19    groups.  The summary shall be updated by the Department every
20    2 years.
21        (c)  The  Department  shall  distribute  the  summary  to
22    hospitals, public health  centers,  and  physicians  who  are
23    likely to treat medical conditions described in paragraph (1)
24    of  subsection  (a).  Those hospitals, public health centers,
25    and physicians shall make  the  summaries  available  to  the
26    public. The Department shall also distribute the summaries to
27    any  person,  organization,  or other interested parties upon
28    request. The summary may be duplicated by any person provided
29    the copies are identical to the current summary  prepared  by
30    the Department.
31        (d)  The  summary  shall  display  on  the  inside of its
32    cover, printed in capital letters and  bold  face  type,  the
33    following paragraph:
34        "The  information  contained in this brochure is only for

 1    the purpose of assisting you, the patient,  in  understanding
 2    the medical information and advice offered by your physician.
 3    This  brochure  cannot  serve  as  a substitute for the sound
 4    professional advice of your physician.  The  availability  of
 5    this  brochure  or  the  information  contained within is not
 6    intended to alter, in any way, the existing physician-patient
 7    relationship, nor the existing  professional  obligations  of
 8    your  physician  in  the delivery of medical services to you,
 9    the patient."
10        (e)  The Department shall periodically survey  hospitals,
11    public  health centers, and physicians to whom the summary is
12    distributed to assess  utilization  by  the  women  that  are
13    served.

16        Sec. 2310-430.  Women's health issues.
17        (a)  The Department shall designate a member of its staff
18    to  handle  women's health issues not currently or adequately
19    addressed by the Department.
20        (b)  The staff person's  duties  shall  include,  without
21    limitation:
22             (1)  Assisting in the assessment of the health needs
23        of women in the State.
24             (2)  Recommending  treatment  methods  and  programs
25        that   are   sensitive   and   relevant   to  the  unique
26        characteristics of women.
27             (3)  Promoting awareness of women's health  concerns
28        and   encouraging,   promoting,   and   aiding   in   the
29        establishment of women's services.
30             (4)  Providing  adequate and effective opportunities
31        for women to express their views on  Departmental  policy
32        development and program implementation.
33             (5)  Providing  information  to  the  members of the

 1        public, patients, and  health  care  providers  regarding
 2        women's  gynecological cancers, including but not limited
 3        to the signs and symptoms, risk factors, the benefits  of
 4        early  detection  through appropriate diagnostic testing,
 5        and treatment options, as well as information  concerning
 6        the   health   risks   associated   with  lead  poisoning
 7        (including the risk of breast-feeding a newborn infant by
 8        a woman whose level of lead poisoning  is  identified  as
 9        posing  a  risk  to  a  nursing  infant) and the need for
10        screening for lead poisoning.
11             (6)  Publishing the  health  care  summary  required
12        under Section 2310-425 55.66 of this Act.
13        (c)  The   information   provided   under   item  (5)  of
14    subsection (b) of  this  Section  may  include,  but  is  not
15    limited to, the following:
16             (1)  Educational   and  informational  materials  in
17        print, audio, video, electronic, or other media.
18             (2)  Public     service      announcements       and
19        advertisements.
20             (3)  The  health care summary required under Section
21        2310-425 55.66 of this Act.
22        The Department may develop or  contract  with  others  to
23    develop,  as  the  Director  deems appropriate, the materials
24    described in this subsection  (c)  or  may  survey  available
25    publications  from,  among other sources, the National Cancer
26    Institute and the American Cancer Society.  The staff  person
27    designated  under  this  Section shall collect the materials,
28    formulate a distribution plan, and disseminate the  materials
29    according  to  the  plan.   These  materials  shall  be  made
30    available to the public free of charge.
31        In  exercising  its powers under this subsection (c), the
32    Department  shall  consult  with  appropriate   health   care
33    professionals  and  providers,  patients,  and  organizations
34    representing  health  care  professionals  and  providers and

 4        Section  99.  Effective date.  This Act takes effect upon
 5    becoming law.".
