 1        AN ACT in relation to foreign trade zones.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Foreign  Trade  Zones Act is amended by
 5    changing Section 1 as follows:

 6        (50 ILCS 40/1) (from Ch. 24, par. 1361)
 7        Sec. 1.  Each of the following units of local  government
 8    and  public  or  private corporations shall have the power to
 9    apply to proper authorities of the United States  of  America
10    pursuant  to  appropriate  law  for  the  right to establish,
11    operate, maintain and lease foreign trade zones and sub-zones
12    within its corporate  limits  or  within  limits  established
13    pursuant  to  agreement with proper authorities of the United
14    States of America, as the case  may  be,  and  to  establish,
15    operate,  maintain  and  lease  such  foreign trade zones and
16    sub-zones:
17        (a)  The City of East St. Louis.
18        (b)  The Bi-State Authority,  Lawrenceville  -  Vincennes
19    Airport.
20        (c)  The Waukegan Port district.
21        (d)  The Illinois Valley Regional Port District.
22        (e)  The  Economic  Development  Council, Inc. located in
23    the area of the United  States  Customs  Port  of  Entry  for
24    Peoria,  pursuant  to  authorization  granted  by  the county
25    boards in the geographic area served by the proposed  foreign
26    trade zone.
27        (f)  The Greater Rockford Airport Authority.
28        (g)  After  the  effective date of this amendatory Act of
29    1984, any county, city, village or town within the State or a
30    public or private corporation authorized or  licensed  to  do
31    business in the State or any combination thereof may apply to

 1    the  Foreign  Trade  Zones Board, United States Department of
 2    Commerce, for the right to establish, operate and maintain  a
 3    foreign  trade  zone and sub-zones.  For the purposes of this
 4    Section,  such  foreign  trade  zone  or  sub-zones  may   be
 5    incorporated  outside  the corporate boundaries or be made up
 6    of areas from adjoining counties or states.
 7        (h)  No foreign trade zone may be established  within  50
 8    miles of an existing zone situated in a county with 3,000,000
 9    or  more  inhabitants  or within 35 miles of an existing zone
10    situated in a county with less  than  3,000,000  inhabitants,
11    such  zones  having been created pursuant to this Act without
12    the permission  of  the  authorities  which  established  the
13    existing  zone. However, nothing in this subsection (h) shall
14    be construed to prohibit or prevent the establishment of more
15    than one foreign trade  zone  in  an  area  consisting  of  2
16    adjacent  counties  each  having  a  population  of more than
17    200,000 inhabitants and each having the Mississippi River  as
18    part  of  its  boundary, and these foreign trade zones may be
19    established regardless of their distance from other zones and
20    regardless  of  whether  the  authorities  which  established
21    existing zones have given their permission to the creation of
22    additional zones.
