CRIM CD-WEPNS UNLWFL-RE-ENACTS                                             

Synopsis of Bill as introduced:
        Amends the Criminal Code of  1961  by  re-enacting  and  amending      
   provisions relating to the unlawful use of weapons of Public Act            
   88-860 that were declared unconstitutional by the Illinois Supreme          
   Court in People v. Cervantes, Docket No. 87229, as violating the            
   single subject provisions of the Illinois Constitution. Provides that       
   a violation of carrying or possessing a firearm in a vehicle, or con-       
   cealed on or about one's person, or on or about one's person upon pub-      
   lic lands within the corporate limits of a municipality, is reduced to      
   a Class A misdemeanor if the defendant petitions the court and estab-       
   lishes certain mitigating factors. Provides upon the establishment of       
   these factors, the court shall order the elimination, in police and         
   court records, of the felony charge. Effective immediately.
