MENTAL HLTH-DISCHARGE-NOTICE

Synopsis of Bill as introduced:
Amends the Mental Health and Developmental Disabilities Code.
Provides that before deciding the merits of a petition for discharge
from a mental health facility, the court shall ensure that the person
to be discharged has been examined separately by 2 physicians during
the 45 days preceding that decision and that each such physician has
filed with the court a detailed written report regarding the person's
condition. Provides that before entering an order discharging a
person from a mental health facility, the court shall determine
whether there are any criminal charges pending against the person. If
there are any such charges, requires that notice of the person's
discharge be given to certain law enforcement officials. Provides for
similar requirements in the case of a mental health facility
director's decision to discharge or temporarily release a person from
the facility. Provides for issuance of a domestic violence order of
protection in conjunction with a person's discharge or temporary
release from a mental health facility.
