Short description: 
HUMAN RIGHTS-TORT CLAIM                                                    

Synopsis of Bill as introduced:
        Amends the Illinois Human  Rights  Act.   Provides  that  if  the      
   elements  of  a  tort  claim  require  proof of any fact or element in      
   addition to the facts or elements prescribed by the Act for  a  charge      
   under  the  Act,  the Act does not preempt the filing of an additional      
   action or claim based on that tort claim in an appropriate court, even      
   if that tort claim is inextricably linked to an alleged  civil  rights      
   violation  under  the Act.  If a tort claim and a charge under the Act      
   have the same elements and require proof of the same  facts,  the  Act      
   preempts  the  filing  of  an  action  based on that tort claim in any      
   court.  Applies to charges pending  before  the  Department  of  Human      
   Rights or the Human Rights Commission.  Effective immediately.
