Short description: 
SEWER CHARGES-LIENS                                                        

Synopsis of Bill as introduced:
        Amends the Illinois Municipal  Code  and  the  Sanitary  District      
   Revenue  Bond  Act.   Provides  that  a  lien  for delinquent sewerage      
   service payments shall be superior to any other  lien,  regardless  of      
   when  filed,  except for local, State, and federal tax liens and liens      
   for the support of  dependent  children.    Provides  that  liens  for      
   delinquent  sewerage service payments may be collected and enforced in      
   the same manner as provided for the taxes for the  premises  to  which      
   the  services  were rendered.  Provides that the payment of delinquent      
   charges for sewerage service  to  any  premises  may  be  enforced  by      
   discontinuing  either  water  service  or  sewerage  service  to those      
   premises, or both.  Effective immediately.                                  
        HOUSE AMENDMENT NO. 1.                                                 
        Removes amendatory language in the bill providing that  the  lien      
   for unpaid sewerage charges shall be superior to any other lien except      
   for  local,  State  and federal tax liens and liens for the support of      
   children and  restores  existing  language.   Removes  the  amendatory      
   provision that liens for delinquent sewerage payments that are entered      
   on the tax rolls shall be collected and enforced in the same manner as      
   provided for taxes and the enforcement of the lien for taxes.               
        HOUSE AMENDMENT NO. 2.                                                 
        Deletes everything.  Amends the Illinois Municipal Code  and  the      
   Sanitary   District   Revenue  Bond  Act.   Provides  that  liens  for      
   delinquent sewerage service charges may be certified annually  to  the      
   proper  tax assessing office, which shall enter the delinquent charges      
   upon the next tax roll.  Moneys collected shall  be  remitted  to  the      
   municipality  or  sanitary  district,  as  the case may be.  Effective      
   immediately.                                                                
        SENATE AMENDMENT NO. 1.                                                
          Adds reference to:                                                   
          60 ILCS 1/205-75                                                     
        Deletes everything.  Amends the Township Code, the Illinois            
   Municipal Code, and the Sanitary District Revenue Bond Act. Provides        
   that the payment of delinquent charges incurred after the effective         
   date of this amendatory Act for sewerage service to any premises may        
   be enforced by discontinuing either water service or sewerage service,      
   or both, to those premises. Provides that a charge is delinquent if it      
   is more than 60 days overdue. Provides that the provider of sewerage        
   service shall not request discontinuation of water service before           
   sending a notice of the delinquency to the sewer user and affording         
   the user an opportunity to be heard. Provides that before a provider        
   of water service that is subject to the rules of the Illinois Commerce      
   Commission disconnects water service under these Act, the provider          
   must do so in substantial compliance with procedural rules of the           
   Illinois Commerce Commission regarding disconnection of water service.      
   Provides that "sewerage service" means treatment, collection, or            
   transport of sewerage. Effective immediately.
