Short description: 
WORKERS COMP-MEDICAL SAVINGS                                               

Synopsis of Bill as introduced:
        Amends the Illinois Insurance Code.  Provides that,  following  a      
   conviction  of  a person of an offense involving a fraudulent workers'      
   compensation  insurance  claim  and  a  finding  by   the   Industrial      
   Commission   of   noncompensability,   the   insurer  shall  file  the      
   appropriate documents to  remove  the  fraudulent  and  noncompensable      
   claim from the employer's experience modification factor.                   
        HOUSE AMENDMENT NO. 1.                                                 
        Deletes  the  amendatory  changes  in  the  bill  as  introduced.      
   Provides that, in making workers' compensation  insurance  rates,  due      
   consideration shall be given to expenses that are specifically (rather      
   than specially) applicable to this State.                                   
        HOUSE AMENDMENT NO. 3.                                                 
          Deletes reference to:                                                
          215 ILCS 5/456                                                       
          Adds reference to:                                                   
          820 ILCS 305/10.1 new                                                
        Deletes  everything.   Amends  the  Workers'  Compensation   Act.      
   Permits  parties  to  enter  into  a compromise lump sum settlement in      
   either permanent total or permanent  partial  disability  cases  which      
   prorates  the  lump  sum  settlement  over  the life expectancy of the      
   injured worker. Provides that in those cases: (i) neither  the  weekly      
   compensation  rate  paid throughout the case nor the maximum statutory      
   weekly rate applicable to the injury  applies;  (ii)  no  compensation      
   rate  shall exceed the maximum statutory weekly rate as of the date of      
   the injury; and (iii) the prorated rate  set  forth  in  the  approved      
   settlement   documents  becomes  the  rate  for  that  case.  The  new      
   provisions are retroactive in effect.                                       
        SENATE AMENDMENT NO. 1. (Senate recedes April 15, 2000)                
        Deletes language providing that the new Section is retroactive in      
   effect.                                                                     
        SENATE AMENDMENT NO. 2. (Senate recedes April 15, 2000)                
          Adds reference to:                                                   
          820 ILCS 305/18.5 new                                                
          820 ILCS 310/18.5 new                                                
        Amends the Workers' Compensation Act.  Provides  that,  after  an      
   employee  has  been  convicted  of  an  offense involving a fraudulent      
   workers' compensation claim,  an  employer  has  standing  before  the      
   Industrial  Commission  for  the  sole  purpose  of filing and seeking      
   disposal  of  the  claim.   Adds  similar  language  to  the  Workers'      
   Occupational Diseases Act.                                                  
        SENATE AMENDMENT NO. 4.                                                
          Deletes reference to:                                                
          820 ILCS 305/10.1                                                    
          820 ILCS 305/18.5 new                                                
          820 ILCS 310/18.5 new                                                
          Adds reference to:                                                   
          New Act                                                              
          35 ILCS 5/203                   from Ch. 120, par. 2-203             
        Deletes everything.  Creates the Medical Care Savings Account Act      
   of 2000, with provisions similar to those of the repealed Medical Care      
   Savings Account Act.  Provides that the Act is repealed on January  1,      
   2010.  Amends the Illinois Income Tax Act to add references to the new      
   Act. Effective immediately.                                                 
        SENATE AMENDMENT NO. 5. (Senate recedes April 15, 2000)                
          Adds reference to:
