Short description: 
MIN WAGE 2% PUNITIVE DAMAGES                                               

Synopsis of Bill as introduced:
        Deletes  all  existing  provisions  of  the  Minimum   Wage   Law      
   concerning recovery of underpayments of wages by employees, assignment      
   of  wage  claims to the Department of Labor for collection, penalties,      
   and supervision by the Department of Labor of payment of unpaid  wages      
   to  employees.  Inserts  provisions  allowing  an  employee to recover      
   underpayments of wages in a "private  civil  action".   Provides  that      
   "such employer shall be additionally liable to the employee for a late      
   payment  penalty  in  the  amount  of  2%  of  the  amount of any such      
   underpayments for each month during which  such  underpayments  remain      
   unpaid,  or  in  an  amount  equal to such underpayments, whichever is      
   greater". Provides  that  the  Director  of  Labor  is  authorized  to      
   supervise  the  payment of unpaid wages and may bring any legal action      
   necessary to recover unpaid wages and penalties.  Applies  to  pending      
   claims and suits.
