Short description: 
HEALTH CARE SURROGATE                                                      

Synopsis of Bill as introduced:
        Amends  the  Health  Care  Surrogate  Act.    Adds   definitions.      
   Provides that certain information must be provided to a patient orally      
   and  in  writing  before  implementation  of  any  treatment decision.      
   Provides for a  patient's  right  to  object  to  the  appointment  or      
   identity  of  a surrogate decision maker or to any decision to be made      
   by the  surrogate.   Restricts  the  power  of  a  surrogate  to  make      
   treatment  decisions  to  a  period  of  90  days  unless,  before the      
   expiration of that period, it is determined that the patient continues      
   to lack decisional capacity.  Provides that  in  no  event  shall  the      
   power  of  a  surrogate  extend for a period longer than one year, and      
   provides for continued treatment after that period  if  authorized  by      
   other means.                                                                
          FISCAL NOTE (Department of Public Health)                            
          HB721 would not create a fiscal impact for the Department.           
        HOUSE AMENDMENT NO. 1.

          Adds reference to:                                                   
          755 ILCS 40/60 new                                                   
        Deletes  everything.   Amends  the  Health  Care  Surrogate  Act.      
   Provides that a surrogate  decision  maker  may  not  consent  to  the      
   administration  of   authorized involuntary treatment under the Mental      
   Health and Developmental Disabilities Code or admission  to  a  mental      
   health   facility.  Authorizes  a  surrogate  to  petition  for  those      
   services. Effective January 1, 2000.                                        
        GOVERNOR'S AMENDATORY VETO MESSAGE                                     
        Recommends that HB721 be amended to provide that the amendatory        
   provisions added to the Health Care Surrogate Act by the bill do not        
   grant a court-appointed guardian any additional authority to consent        
   to specific mental health services than is permitted by the Mental          
   Health and Developmental Disabilities Code.
