O'MALLEY. 415 ILCS 5/39.6 new 415 ILCS 5/42 from Ch. 111 1/2, par. 1042 Amends the Environmental Protection Act. Provides that the Environmental Protection Agency shall not issue a permit for the construction, installation, or operation of a refinery facility that is located within one mile of school property unless the Agency includes specified conditions in the permit. Provides a civil penalty of $100,000 for a second or subsequent violation of the Act and an additional civil penalty of not to exceed $20,000 for each day during which that violation continues.
