DONAHUE. 210 ILCS 45/3-808 new 210 ILCS 45/3-809 new Amends the Nursing Home Care Act. Provides that the State is liable to a resident of a facility for any intentional act or omission of one of its agents or employees that causes an injury to a resident or aggravates an injury of a resident. Provides that an employee shall be personally liable for damages that result from his or her misrepresentation or failure to accurately portray the conditions in a long-term care facility during an inspection or survey.
