   720 ILCS 5/20-3 new
   720 ILCS 5/24-1 from Ch. 38, par. 24-1
   720 ILCS 5/25-1.1
   720 ILCS 550/7 from Ch. 56 1/2, par. 707
   720 ILCS 640/1 from Ch. 23, par. 2369

Amends the Juvenile Court Act of 1987 to name 3 offenses for
which a minor will be prosecuted as an adult. These generally involve
possession of explosives or certain weapons on or within 1000 feet of
school properties. Deletes 2 offenses from the category of offenses
for which a minor must be prosecuted as an adult. Although these
involve possession of weapons considered less dangerous, the minor
would still be subject to discretionary transfer to adult court, upon
motion of the State's Attorney. Makes offenses involving possession
of certain other dangerous weapons on school property subject to
discretionary transfer to adult court, upon motion of the State's
Attorney. Amends the Criminal Code of 1961 to add a Class X felony
offense involving possession of explosives or incendiary devices on or
near school property with the intent to commit an offense or knowing
that another will use the explosive or device to commit a felony.
Also amends the sentencing provisions for offenses involving dangerous
weapons on or near school property to designate these offenses (and
the newly added offense) as Class X felonies. These are now
non-probationable offenses carrying a sentence of 10 to 60 years.
Also amends the Code to provide that contact with a street gang member
in violation of a parole or supervision order, or when the contact
violates any court order, is now a punishable misdemeanor offense.
Deletes a provision of the Cannabis Control Act concerning treatment
of an offense under the Juvenile Court Act of 1987. Amends the
Improper Supervision of Children Act by broadening the petty offense
of improper supervision of a child to include anyone who knowingly
permits a minor in his or her custody or control to associate with any
   known street gang members.
          FISCAL NOTE (Dept. of Corrections)
