   430 ILCS 15/2             from Ch. 127 1/2, par. 154                        

        Amends the Gasoline Storage Act.  Makes a technical change in the      
   Section concerning jurisdiction and regulation of tanks.                    
          FISCAL NOTE, H-AM 1 (State Fire Marshal)                             
          Approximately $100,000 to $200,000 revenue per year may be           
          needed to initiate and maintain a safety and inspection pro-         
          gram. Expenses are expected to cost $150,000. Revenue from           
          fees established to fund this mandate should be sufficient           
          to support the new duties of fire safety inspections, regula-        
          tory compliance and the necessary clerical activities for a          
          permitting program. More definitive costs could be projected         
          when the number of potential companies is known.                     
          STATE MANDATES NOTE, H-AM 1                                          
          (Department of Commerce and Community Affairs)                       
          This legislation creates a service mandate for which 50% to          
          100% of the increased costs to units of local government is          
          required under the State Mandates Act. Until such time as            
          rules are promulgated, the extent to which costs, if any,            
          may be imposed is unknown.                                           
          HOME RULE NOTE, H-AM 1                                               
          (Department of Commerce and Community Affairs)                       
          The section of the law being amended currently pre-empts home        
          rule authority. Therefore, home rule units of local government       
          would be required to comply with any regulations promulgated         
          by the State Fire Marshal relating to the refueling of vehicles      
          owned, leased, or operated by such units.                            
          BALANCED BUDGET NOTE, H-AM 1 (Bureau of the Budget)                  
          Since this legislation is not a supplemental appropriation           
          bill, the Balanced Budget Note Act is inapplicable.                  
          HOUSING AFFORDABILITY NOTE, H-AM 1                                   
          (Housing Development Authority)                                      
          There would be no fiscal effect on constructing, purchasing,         
          owning or selling a single-family residence.

          Adds reference to:                                                   
          35 ILCS 505/1.9                 from Ch. 120, par. 417.9             
        Amends the Gasoline Storage Act to provide that  the  State  Fire      
   Marshal shall not prohibit the dispensing of motor fuels directly into      
   the  tanks  of  motor  vehicles  from tank trucks or portable tanks at      
   certain specified types of sites and for certain government vehicles.       
   Amends the Motor Fuel Tax Law to provide that the sale of  motor  fuel      
   from a portable tank shall be deemed to occur at the location where it      
   was dispensed into the fuel tank of a motor vehicle.                        
        SENATE AMENDMENT NO. 1.                                                
          Deletes reference to:                                                
          35 ILCS 505/1.9                                                      
        Replaces everything after the enacting clause with the  engrossed      
   version of the bill with the following changes. Deletes the provisions      
   amending  the  Motor  Fuel  Tax  Law.  Makes changes in the provisions      
   requiring the State Fire Marshal to adopt rules  in  relation  to  the      
   dispensing  or  delivery of certain fuels directly into the fuel tanks      
   of vehicles from tank trucks, tank wagons, or other portable tanks.
