CURRIE-FEIGENHOLTZ AND MULLIGAN.

(CRONIN-CULLERTON)

   750 ILCS 50/14b new                                                         

        Amends the Adoption Act.  Provides that if an  intended  adoptive      
   parent  dies  before entry of final judgment, upon petition, the court      
   may proceed to  hearing  and  final  judgment  to  enable  the  living      
   intended  adoptive  parent to adopt the child, otherwise the court may      
   dismiss the proceeding.  Provides that,  if  the  adoption  proceeding      
   begins  after  the  death  of  an  intended adoptive parent, the child      
   intended to be  adopted  shall  not,  by  the  adoption,  acquire  any      
   interest in the estate or acquire any other right or incur any duty or      
   obligation  of  the  deceased intended adoptive parent.  Provides that      
   this amendatory Act of the 91st General Assembly shall  apply  to  all      
   cases  in  which  the court acquired personal jurisdiction on or after      
   November 1, 1997.                                                           
          FISCAL NOTE (Department of Children and Family Services)             
          DCFS expects no measurable fiscal impact.                            
        SENATE AMENDMENT NO. 1.                                                
        Removes provision that if the adoption proceeding commences after      
   the death of an intended adoptive parent, the  child  intended  to  be      
   adopted shall not, by the adoption, acquire any interest in the estate      
   or  acquire  any  other  right  or incur any duty or obligation of the      
   deceased intended adoptive parent.
