WINKEL-MCCARTHY-MATHIAS.

(HAWKINSON-SILVERSTEIN)

   750 ILCS 5/505            from Ch. 40, par. 505                             

        Amends the Illinois Marriage and Dissolution of Marriage Act.  In      
   a provision requiring that the final child support order in all  cases      
   state  the  support  level in dollar amounts, provides that the dollar      
   amount requirement shall be complied with to the extent  possible  and      
   that  the court may also enter any other appropriate order to properly      
   apply the percentage support guidelines so  that  the  proper  support      
   amount is collected on a timely basis.  Effective immediately.              
        HOUSE AMENDMENT NO. 1.                                                 
        Replaces the amendatory language in the  bill  with  a  provision      
   that,  if  the  court  finds  that  the child support amount cannot be      
   expressed exclusively as a dollar amount because all or a  portion  of      
   the  payor's net income is uncertain as to source, time of payment, or      
   amount, the court may order a percentage amount of support  either  in      
   addition  to or in lieu of a dollar amount and enter other orders           
   to collect support on a timely basis.                                       
        GOVERNOR'S AMENDATORY VETO MESSAGE                                     
        Recommends the removal of the conditional phrase "to the               
   extent possible" from the existing requirement that a final child           
   support order state the support level in dollar amounts.  Recommends        
   that the amendatory language authorizing the court to order support as      
   a percentage of income in lieu of a stated dollar amount be removed,        
   and instead provides that support shall be stated as a specific dollar      
   amount, allowing it to be stated as a percentage of income in               
   addition.
