   720 ILCS 5/24.5-5                                                           
   720 ILCS 5/24.5-10                                                          

        Amends the Criminal Code of 1961.  Changes the penalties for  the      
   unlawful possession of nitrous oxide and for the unlawful manufacture,      
   delivery,  or  possession  with  intent to manufacture or deliver (now      
   sale, distribution or giving away) of nitrous oxide  from  a  Class  B      
   misdemeanor to a Class 3 felony.                                            
        HOUSE AMENDMENT NO. 1.                                                 
        Provides that the penalty for the unlawful possession of  nitrous      
   oxide  is  a  Class  A  misdemeanor  for a first offense and a Class 4      
   felony for a second or subsequent offense.
